Question about copyright law

I have a legal question and I want to make sure that I am acting within the
law (not breaking it).
On the internet there is an audio presentation that is available to listen
to simply "by the clicking." There is no fee involved, it is freely
available and widely listened to, and there is no copyright notice anywhere
on the website.
But, you have to listen to it online (streaming audio).
I have listened to the presentation and saved it to my computer.
Here is my question: Is it legal for me to burn it to a CD and sell it for a
nominal fee ($3)? This barely covers the cost of the hardware, software,
and materials involved, and it gives people the freedom and ability to
listen to it in their car or in their stereo instead of having to sit in
front of their computer for an hour.
IMO, I'm providing a service by doing labor and legwork in order to provide
it in a more convenient fashion, but I want to make sure it is legal.
