State court trying to rewrite Constitution

Colorado's Supreme Court chose privacy concerns over the First Amendment
when it upheld a gag order on information that was released about Kobe
Bryant's accuser.
The Colorado Supreme Court must have been blinded by the bright lights of
the Kobe Bryant case in its decision to prohibit the news media from
publishing information inadvertently circulated by the Eagle County district
court.
The U.S. Constitution and subsequent court rulings bar the government from
exercising "prior restraint" on what the press can publish. Exceptions are
few and far between.
Monday's narrow, 4-3 court decision is an impermissible encroachment on the
First Amendment. It was an effort to balance First Amendment and privacy
concerns, a delicate task. But the decision was one of flawed logic that
would set a bad precedent.
Based on previous decisions by the nation's highest court, prior restraint
is allowed under only the severest circumstances. Courts have been
consistent on this - even national security concerns do not typically
override the prohibition. The Pentagon Papers was a case in point.
Comes the Colorado Supreme Court, ignoring past precedent, galloping into
the legal abyss.
In dissent, Justice Michael Bender noted that the decision authorizes the
government "to censor the media, which is precisely the power the First
Amendment forbids." And he correctly notes that the privacy interests raised
in this case is ephemeral or less.

Yh, no. The Colorado courts are blinded by their pink robes and the
pinkwash they have painted their court rooms with. Anything a female
wants is the "law" in Colorado. If Ms. Faber doesn't want the 1st
Amendment applied, then the pink court will not apply it.
To understand Colorado law you have to understand the difference between
justice and feminism. Colorado always comes down on the side of feminism.

As opposed to one of those "other" courts, populated by judges who rule a
rape case based upon how the victim was dressed? I'm sorry, jackass, but a
person is innocent until they are proven guilty, and the victim is not
automatically lying, whether the state is pro-woman, or the defendant is a
rich participant in a VASTLY popular sport.
If Kobe is such a horny goat #@&@
that he has to have sex with a stranger,
even after admitting he noticed she was bloody, then I think he needs to
give his woman alot more than a big diamond ring. I can't imagine how horny
an attractive celebrity would have to be in order to just hump the first
woman who came near him. Maybe the NBA should look into a character
suspension. Maybe if these guy weren't worth multi-millions, they might
behave better. There's alot of blame to go around.
There's only one person who can properly answer whether or not Kobe raped
that woman.....Kobe. Only he knows what he felt, what he wanted, and why he
did it. It's up to a jury to decide whether or not he and his defense team
have lied to them enough for them to distrust his story.
To understand Colorado law you have to understand the difference between
justice and feminism. Colorado always comes down on the side of feminism.
To understand the "other" side of feminism, you've got to understand the
merits and importance of dress and accessories, as well as "pyschic
phenomena", to determine whether or not the woman was asking to be raped.
"I didn't rape her. Her eyes wanted me to do it."

Which part do you question?
'Horny goat #@&@
' seems a little strong, but there he was 'having sex with
a stranger' (unless you postulate a long courtship there).
Is it 'noticed the blood'? Maybe he missed that, shirt or no shirt- he seems
impulsive.
'Give his woman......ring'? She seems a spoiled, vindictive kind of lady-
bet he's got a hard row to hoe; or a hard ho' to throw- hard to say.

That part where Kobe "admitted knowing she was bloody". In fact, Detective
Donut had the shirt in his custody and did not notice any blood, even though
Kate Faber said she bled. CBI was the one to notice the blood, which was
transferred from another source.

As I recall, Kobe's statement was that she was "already" bleeding, and that
he wasn't the cause of it, but that the sex was consentual. Thus, it's safe
to say that rather than deny anything went on, his "confession" makes him
even more suspicious, as it claims she was already bleeding, yet he f*cked
her anyway, which not only would make him a VERY horny goat #@&@

really weird. I'd think if he was such a freak, someone would be able to

Indeed. If you believe Katelyn ("the victim") Faber, she wasn't
raped. She's not lying at all. She went to a man's hotel room "for a
sexual encounter" at midnight and got a sexual encounter. The whole
pink fabric of Colorado Injustice is lined up to persecute men, even
rich men. The detective asked if, during the sexual encounter, she had
ever told Bryant "no" and she did not claim to have done so.
If she doesn't even claim she was raped, what's the charge? There has to
have been a police report. Who was the victim of rape if not her?
If she indeed didn't claim she said no, and wasn't raped, why would she even
be called to testify for the prosecution at all? Doesn't make sense.

If he did "admit" it, the media would be all over it. But no mention

But hey, I guess Entertainment Tonight is more reliable than Court

Or stop making a big deal out of women who seek out the players in their
hotel rooms to have sex with them. If they got "raped," it's a crime, yes.
But is it a big deal? No. It's not on a level with the woman who gets
raped in her bed by a predator who came through the window. It's not on a
level with children who get raped. It's not on a level with a whole lot of
crimes in this world. If he vaginally raped her after she said
"yes...no...yes...no," Kobe Bryant should do some minor time. If he raped
her up the butt against her will, he should do some more time (because it's
reasonable to think she didn't expect that). But to make a huge issue out
of this is to distort people's perceptions about real crime, and everybody
knows feminists wouldn't want to distort people's perceptions.

If you rape someone, you should do the time for raping someone. How
forcefully or not you raped them is about as important as whether or not you
shot that store clerk with one bullet or three. She's just as dead, and the
rape victim is just as raped, whether you raped her in her vagina, or in her
ass.

Kobe hasn't made any statements in regards to details of the case. He
can't.
If he did "admit" it, the media would be all over it. But no mention
anywhere in any court documents or newspaper article. Oops.
Did you watch it? I'm guessing it'll be a no.
But hey, I guess Entertainment Tonight is more reliable than Court
documents.
I never said that.

If you believe the statements of Katelyn (the VICTIM) Faber, it was only
"rape" by feminist definition. She didn't have as much fun as she
hopped, and felt bad the next day. Outside of feminist hysterical
rape-hate ranting, she wasn't raped.
I guess we'll have to let the court determine who was raped or not.

As if a bunch of hand picked feminist wusses will make an intelligent
decision. NOT!
The AIS marches on.

If you rape someone, you should do the time for raping someone.
That's the usual feminazi claim. How very bigoted of you. Sex is worth
no more than $100 on the streets here. A penalty about equal to a
traffic fine would be much more equal to the crime.
How
forcefully or not you raped them is about as important as whether or not you
shot that store clerk with one bullet or three.
It's like the difference between grabbing a 6 pack and running, or
shooting the clerk. In rape and running with the 6 pack nobody got
injured.

Nope. Her cunt's normal function is to be rubbed with a cock, that's
what it does, and it is not injured by doing it's normal function any
more than your feet are injured by walking.

No, your memory conflicts with reality. Come on. Find one single solitary
source that says that Kobe Bryant gave any statement at all regarding any
evidence in this case.
I mean, if it was on Entertainment Tonight, then it must be all over the net
by now.
Scurry off and come back with it. I'll give you a cookie.
