EEOC Abritration (ADA)

Im looking for feedback on my ADA case with the EEOC Abitration. I am
learning disabled and feel that my employer has discriminated against me for
an upcoming promotion. I work in private industry under a union collective
bargaining agreement. The agreement speaks of seniority based promotion and
I was next in line for the position. I believe the person underneath me was
promoted because he would, and subsequently had completed his training in 4
weeks, where I requested 8 weeks. I have glowing notarized recommendations
from the union supervisor and even the management that's being charged.
I feel I have a very strong, but I know the ADA offers employers a million
way's to dismiss charges like this. What angle could come at to get out of
this?
I am not going after my union, but the management of my company.
Any advice would be greatly appreciated, they have also agreed to
arbitration and I am currently seeking counsel to represent me. Anyone
attorneys in the New York City area that has experience with collective
bargaining agreements and the ADA please feel free to email me, or reply
here.
