I need some advice on what to do now. I recently was denied SSI. I sent them medical records, and my doctor sent them papers as well. I had x-rays done of my back in July of this year due to pain. X-rays showed that I have wedging of the vertebral body. Also it showed that I have Degenerative Disk Disease with spurring up and down my spine. I am in much pain all the time. I also had bloodwork done at the same time. I am a type 2 diabetic, have very high blood pressure, and high cholesterol. I am also obesed, I am 5'0" and weigh around 325 lbs. I am on several medications which include: 2000mg Metformin, 1200mg Lopid,150mg Voltaren, 20mg Zestril, 30mg Glucotrol, 300mg Zantac, and 20 mg Flexeril (all I take twice a day except the Flexeril which is once a day). I also have to check my sugar 4 times a day, and my blood pressure once a day. My doctor says I am a ticking time bomb. I recently had an infected cyst removed from my back, and 2 ruptured eardrums due to infection. Doctor says I will continue to get infections because of the diabetes. I also have circulation problems in my feet, legs, and hands because of the diabetes. My doctor has me on restrictions because of my spine which makes it even harder to find work. The restrictions include no bending, no stretching, and no lifting anything over 5 pounds. Before applying for disability I have tried to get work, but I get turned down, employers say that I am a health risk. Everytime I go to the doctor or get meds I have to borrow money. My oldest son lives with me because I have no income, but someday he will want to get married and get his own place. I live in Charlotte, Michigan, USA which is about 20 miles south of Lansing. Is there anything I can do so that I can pay my bills and continue my medical treatment. If I don't get help soon, I will have to stop medications and going to the doctor. I do get the Barry-Eaton Health thru the health department, but I still have to pay co-payments, and it don't pay for other services that diabetics need such as dentist, eyes, and foot doctors. I just don't know where to turn to. Betty

What was the basis for denial? Not severe impairment? Ability to do past work? Ability to do other work? What is your age and education? What work have you done in the past 15 years? It said ability to do past work. Which is false, all I have done in the past 15 yrs is fast food, and electronic repairs such as TVs and Microwaves. I have a 2 yr. degree in Electonics Engineering Technology. There is a lot of lifting in both. In Dec 2002 I got a job at a Red Roof Inn as a housekeeper, and they fired me because they said I was too slow. But I can't help but be slow because of my weight I get short of breath and chestpains. That was the last job I been able to get. I even tried a place called Peckham that hire disabled people, and they turned me down because of my health. Betty

No expert here, but I share some of your disabilities except diabetes, only borderline there so far, but ... If you haven't done the request for reconsideration as Brojack suggested, DO IT! Do not let anything lapse. I -think-, I don't know, you don't fit any of their "standard" list of disabilities and for whatever reason everyone I've heard of has a tough time that way. Ask your doctor to state in writing that you are disabled and won't improve. Send it to them and add it to your own files. Keep very detailed records of every medical/health issue. Leave opinions out of those lists; just state facts. Never volunteer anything, don't ever state what you CAN do, only state what you can't. It sound like the answer to every "why can't you" should be "because of the pain". It took me nearly 5 years to get thru the process, but I hear that's not the norm. However, if my feeling is correct, it will take a long time - they are not very fair people when they can't look at their lists and see your disease specifically listed. I did get almost 5 year's back benefits, but ... they took a lot back in taxes and I lost most of my posessions in the process. About all I have left is my computer to keep in touch with the world, and it's a blessing. Be patient, be calm, be very persistant, and never be rude no matter how many lies they put in writing: the lies seem to be the "norm" and they're stated so that legally they aren't lies. In my opinion, you will likely be turned down again, and have to go before an Administrative Law Judge to get it settled. See if you can get hold of the SS Physical form, 502 or something like that (anyone know what the right number is for sure?). Your doctor probably already has it in your files in his office. If not, get a copy and get it filled out for evidence. It's available to you, and will tell you a lot about how they look at things. You already meet a lot of the requirements from what you said. Assuming you've been honest in your post, you will make it - just stay calm, clear, concise, patient, and most of all persistant. Regards, Pop

I presume you mean SSDI rather than SSI. I suggest you contact an advocacy firm such as Binder & Binder http://www.binderandbinder.com and see what they have to say. They will take part of anything they get for you, but half a loaf is better than nothing. Also, since this is an election year, I recommend that you contact your state and federal representatives. I tried SSDI but I can't get that because I haven't got my quarters in. They said I didn't work enough. So they transferred my case to SSI. Betty

Your MD has said no bending and no lifting above 5 lbs. You didn't say, but presumably, he also has limited you severely with respect to standing/walking and sitting, and these opinions are in your folder. If DDS disagrees with a treating MD's quantitative opinions of a claimant's ability to do work-related functions, they must explain it with a convincing rationale. Your summarization of the medical findings, if accurate, reasonably support a severely limited residual functional capacity as opined by your MD. Given also your summarization of your past relevant work, I can't see how they reached a past work denial conclusion. I'd love to see their rationale rebutting your MD. File your request for reconsideration. At the recon level, having an atty. does not significantly enhance your likelihood of allowance. If the case progresses to the next level, i.e., a hearing before an administrative law judge, an atty. is essential. There's also a form (it may be the 502 that Pop mentioned, but it's been a long time since I've seen it), that asks questions and the answers can range from None, Moderate, Marked, and Severe. I remember that the questions were simple things, like, my ability to groom myself, ability to sustain work relationships (I don't remember the wording, but I remember the intent). ANYway, there were about 6 or 7 questions, and I remember that as long as the dr. marked more than half as Marked or Severe, it really helped my case. The ALJ used that form as the foundation (but not the sole reason) for approving me. That form may not exist anymore, I don't know. But I know it was worth using it.
