My work is currently trying to get me to quit. They write me up for ridicules things while trying to find every little mistake I make. They are now trying to make me work 50 hours a week even knowing that I go to college. I am on salary so I can't get any overtime. They won't fire me because they don't want to pay the unemployment benefits. Everyone in my office has grown to hate me because I'm not in their 'click.' Even the managers dislike me and they think I'm a bad worker, but there really just piling work on me I can't get done in time. Is this illegal what their doing?

Do something really bad, get fired, look for a way better job , and untill you find a better job live on the unmeployment benefits. Ps, Heads up to you for having so much patience with those @ , if it where me in your shoes i would #@&@ slap all of them incl my boss , get fired and recieve unemployment checks from them lol.

Probably not. Assuming they aren't discriminating against you because of your age, race, gender, etc. Assuming you aren't protected by a union contract. Assuming you don't have some other kind of employment contract that gives you special rights. Assuming they aren't retaliating against you for some "protected" activity. Assuming all those assumptions, and without more information, what they're doing isn't illegal. Do they write you up for these "ridiculous things" while others, who do the same things, are getting a pass? What are these things that you are being written up for? Do you, perhaps, deserve to be written up?

If everything you say is actually true, then maybe you have a constructive dischage alligation? However, since your post was so generic (They hate me, they make me work too much, poor me), it sounds like you either don't like or can't handle the place where you are working. Suck it up, find another job, and don't clog the legal system with another frivolous lawsuit. Beleive me, there's no shame in quitting a job you don't like. I've done it and everyone else has, too. Better to think so than to do so. Getting fired for bad conduct will get you disqualified for unemployment anywhere. Workplace violence will get you room and board at the county hotel, or at best probation with restitution and useless-but-required anger management classes. The OP's best bet might be an improper-classification complaint. You can't give a menial a title like "manager of stacking boxes" to turn him into an exempt employee. -- Not a lawyer, Chris Green

They have classified you as an exempt employee but are you sure you are one? In the Labor Code for your state, there is usually detail about what an exempt employee is considered. Many people are improperly classified as salaried so the company doesn't have to pay overtime.
