Needs some advice on how to proceed with a couple of problems I am having
with my credit reports. One problem is my wife filed bankruptcy several
years ago without telling me. So now when I am ready to refinance the house
the lender says I have a bankruptcy on my report. Some of the credit cards
she included in the bankruptcy, she had me on as a authorize user. Now it
shows up on my credit reports. Any advice on how to distance myself from
her bankruptcy?
My other problem is with a bank credit card. My mother had a credit card
with a balance on it when she died. I took some of the money that was left
in her estate and made a few payments on it. But didn't pay it off. Now
the bank is saying that is my debt and I have to pay it off. I talk with a
number of people at the bank who say they would fix it, take it off my
credit report but it hasn't happen. And the last person I talked to said it
is my debt and I am responsible for it. I have tried to get them to show me
anything where I sign for it or even used it and they can't. I have even
wrote the credit reporting agencies to have them investigate and they come
back that I own them. But I did not sign up for this card and have not used
it. Any advice on my next step to rid myself of this credit card error?

There was a class action about this in the federal court for South
Carolina; I'd check with the court web site for updates.

Assuming that you are still married I know of no way to get this off
your credit report. There must be more to the story and I suggest that
you consult an attorney if you are separated or divorced to see if
anything can be done.

Did you probate your mother's estate? I am assuming that you did not.
You need to go to the probate court and fill out the necesssary
paperwork. Probate may not be required if it is a small estate and the
clerks can help you with the forms. The executor of the estate is
responsible for paying all of the bills from the money/property
contained in the estate. If all of the estate assets were used to pay
bills then you are no longer responsible. If you kept estate assets
then you are still responsible for any remaining bills up to that
value.
If all of the money from the estate is gone then send the bank a
certified letter along with the letter from the court where you were
named executor
stating that there are no more assets in the estate and that they are
to remove the report from your individual credit file. If they do not
then you can file suit against the bank in small claims court.
