Health Insurance Cancellation

My wife and I retired from a government agency a year ago. We maintained
our group health insurance with them by making the payments to the agency
monthly. We were a month late because we were out of town and sent a check
last month catching up our payments. We just, today, received a form
letter from the agency saying that our health insurance has been cancelled
back in March. Also, we checked our bank account and the check that we
sent has not cleared.
We are deeply and gravely concerned about this because my wife has some
serious pre existing health conditions that she was covered for under the
group policy. Do we have any options or rights in a situation like this?
Thank you for any advice or guidance as to how we should deal with this.
It is the weekend and I will, of course, call the agency on Monday but
would like to know where I stand legally on this.

Hmm, sounds like you missed a payment in March. In most cases, being "out of
town" does not prevent you from sending in your payment-- unless of course you
were in a town with no mail service :-)
What you're supposed to do if you do plan to travel for an extended time for a
place with no mail service is to settle your bills BEFORE you leave. Hopefully
you can get reinstated...

If you have any 'rights', the place to start looking for them is your
state's AG's consumer affairs office. IMO, due to your being a high risk,
the insurance company is glad to be rid of you and will be reluctant in the
extreme to reinstate you at your previous rate or maybe any rate.
You should also read your policy carefully to see if there is anything in
that which would allow you a reinstatement. Since all insurance is regulated
by state law, there is little generic advice possible other than the AG
consult and maybe, if you have a responsive department, your state's
secretary of insurance.

Legally you need to read your policy to determine if the company can cancel
you out for one month's failure to pay or pay late. If so, you must
determine if the cancellation clause violates any state regulation or law.
