I am involved in a petition for annulment or in the alternative dissolution
of marriage
the marriage is 10years, entered into in the Ukraine and has a post-marital
agreement excluding support. And additional ageement was entered into 8
years after when a home was purchased.
There are a lot of issues being raised on both sides.
It seems that it would be helpful to get this matter focused. That is if
some issues could be decided by themselves. For example The issue of the
validy of the post-marital agreement (key to deciding support). The issue of
the validity of the marriage (key to deciding what is marital property). The
validity of the additional agreement for the purchase of the home (key to
deciding apportionment of equity interests), lastly a new issue on special
equity (the use of labor in gaining an interest in property) Entering into a
trial with all these issues makes for a huge number of variants to consider.
Each one decided by itself gives clarity in that it establishes a frame work
for the subsequent issure to operate within.
Can one deal with these one at a time.
