student loan bankrupcy

Im trying to consolidate all the defaulted students loans I have out
there. I got a copy of my credit report and put all the lenders on my
Direct Loans application. Five of my loans were consolidated. I thought
I was done, but now Im recieving calls from other lenders that I kind
of just forgot about. It seems that some of the loans, ie Wells Fargo
Collegiate and Key Bank Alternative loans were not federally backed.
Does this mean that I can not consolidate them? If I can, how do I go
about doing that? Can anyone suggest how to find a lawyer in my area
that deals with student loans? I recently filled for bankruptcy. But
this lawyer seems to not deal with student loans. After the bancruptcy
goes through Ild like to get another lawyer to help with my loan
problems.

Mike,
You have defaulted on your student loans and are going through
bankruptcy. Your records are so poor that you do not know to whom you owe
money or under what terms you borrowed. You ask for advice. Student loans
(the kind of loans that are backed by the government, for education) are not
discharged at bankruptcy in the US. You borrowed the money and are expected
to pay it back., bankruptcy won't change this. Your comment about other
lenders that you kind of forgot about is not very reassuring. There are
credit assistance agencies to help people sort out their debt problems. Call
your town or county gov. info line and ask about these agencies. You should
look for a "volunteer" agency or something connected with social services
rather than a private agency that does "debt consolidation". It does not
sound as if you need the help of an attorney.

I do not think you csn bk on student loans. You may, however, get them
forgiven under certain circumstances. Call your lenders, or do some research
on the matter. Good luck.

Student loans are dischargeable under certain circumstances. The
requirements vary a little depending upon the district in which the debtor
files, but the basic test is well articulated in: In re Brunner, 46 B.R.
752, 753 (S.D.N.Y., 1985).
