Small estate. Eviction question

My dad shared his house with a dead beat. Dad had asked him several times to
leave and he wouldnt go. It would blow over and deadbeat would stay. They
would get along for a while. Dad would not take the legal action to make him
leave. Dad was allways saying this guy took his money or ate his food or
borrowed cloths and didnt return them etc. Origionally, dad let him move in
as a tenent. Dad didn't keep any records but the guy only occasionally paid
any rent. Eventually dad had to move back into his house and they shared the
place. I can't prove most of dads accusations but I believed him. The dead
beat is being real polite with me now. We've discussed rent and he's started
paying the utilities. It probably makes business sense to get rent from him
cus the house will need some fixing up before it could be rented to anybody
else. But I don't want that son of a #@&@
es money, I want him out. He took
advantage of my dad for years. I've not asked him to leave because I must
have the legal stuff in place to make it happen. I wish I could through him
out and seal the house and not let him remove anything so I could go through
his things looking for stuff that belonged to dad. Dad wrote 2 checks the
day before he went into the hospital. $50 to the lady that took him grocery
shopping and $150 cash. We found dads wallet with $2 in it. He never spent
more than $40 on groceries. Dad's estate is small and does not require
formal probate administration. I am doing the functions of a personal
representitive for dad. Can I bring action to evict the deadbeat? Or do I
have to transfer the property ownership first. I'm in Indiana. The heirs are
just me and my brother.
