Help! Contractor took money and only delivered excuses

All,
Just over two weeks ago (3/31/05), I contacted a contractor in the
local paper to install a new sidewalk in my house. They promptly came
over the next day measured it and gave me a price and stated that they
would have the side walk done by Saturday (4/2/05). They requested a
$100.00 deposit for the contract to make sure I was serious. I also
have a receipt for the work that was supposed to be done by 4/2/05 and
a receipt for the $100.00 I gave them.
Over the past weeks I've been on the phone with them on and off
and they keep giving me excuses. For instance one excuse was "their
truck broke", or "my partner had to go see some family". I told
them at that time I'll give them a whole week 4/11 - 4/15 to get it
done, and they stated no problem.
Today 4/17 I called them and asked them to drop the $100.00 off by
tomorrow since it was obvious they were not going to do the work. They
told me they would sue the $hit out of me, and I asked them for what
they then went back to we'll drop off your money soon.
Since this is only $100.00 paying a lawyer seems to be pointless.
What else should I do other then file a small claim against his
business? Should I contact the paper, BBB, and anyone else? These guys
were very vulgar & violent on the phone, and I'd hate for them to do
anything physically to my house, etc. or otherwise. Any suggestions?

What State? Is the contractor licensed by the state? Do you have the
contractor's license number?

Check the status of the contractor's license. In some states there are
extra penalties depending upon whether the person is properly licensed to
do the work contracted for. If your state has a contractor's licensing
board or division you can get more information from them.

Also check with your state's attorney general. The BBB and perhaps
your state may have web-enabled filing, which makes it convenient.
