I made the mistake of renting from a greedy irritating Landlord. I had a month to month lease, but I didn't notice further down in the lease it says I will not recieve my security deposit back until after the 11th month. Is this legal? I am assuming that since I am on a month to month lease then my security deposit should be the same? I assumed that this was just a mistake on my landlords part when they typed the lease. It may have not been though since now they seem to be unwilling to refund me my money. I gave the landlord in October first months rent of $650, Last months rent of $650, security deposit of $625, a key deposit of $65 and a non refundable pet deposit of $150. I lived in the House from October 1, 2004 to March 30, 2005 when I returned the keys. I had sent a 30 day notice letter the day before on March 29 and basically forfeited the prepaid rent I had paid because noone has ever moved into this place. I had to take a job in another city unexpectedly and I didn't have time to give advance notice, but since I had already paid for the last month i didn't think it made a difference. On May 1 I call the Landlord again to ask for my deposit money back. I should at least recieve my key deposit back and I'm not sure if I'm entitled to the security deposit with the way the lease is worded. The Landlord tells me he has another 30 days from May 1. I was under the impression that the deposits were to be refunded 30 days after the keys are surrendered. I fired off another demand letter in certified mail asking for my deposits back. Where should I go from here? How long should I wait for them to respond and what should I do or be thinking at this point? Is court my only answer? Will I get my Security Deposit back with this wording in the lease about not getting it back till the 11th month. I left the house in the same condition I rented it in and I don't understand why these people wont refund my money. I never signed any type of move in or out sheet either. I took pictures of the place for my own protection too.
