Slip and fall injury case

On 7-8-03 I slipped from a single unattached step at the University of
Montana. I broke both sides of my ankle and dislocated it. I had
sergury to correct the break with use of plates and pins. I am a
single mom with two children, I 've lost all income due to the injury,
can't walk, use a wheele chair, and can't stand for more than 1/2
hour. My foot is still swollen, red, and the movement is limited. My
doctor told me don't know the extent of ligament damage, future
damage, perm. damage, future range of motion, future arthrites, or
future level of pain. He also said that stiffness and loss of motion
range is associated with my injury. My attorney said I can not get
life time medical on my foot instead 1 lump sum settelment.
I know person who is going in for a $40,000 sergury due to an ankle
breake dislocation injury 5 years ago, someone with sever ankly
sprange 1yr. old with daily pain and swelling, another with 10 yr. old
ankle break with continued pain.
My questions are: HOw will I recieve a fare settelment to cover my
future if my future is unknown? My doctor said we wont know about
alot of my medical concerns until the time: 5-10-20 years from now.
Should my doctor be able to answer more questions, the like ligament
damage at this time? What will happen if I loose my house due to lack
of payment because of my injury? Will it be included in my case and
to what extent? Are there any services or resources that may help me
pay my bills durring this time?

These are all questions to consider with your lawyer. As time passes,
your medical costs will be more certain, but it will be harder to prove a
case as time passes, so there's a tradeoff. But I would think doctors
could estimate your lifetime expenses (# of surgeries, # of doctors visits
and therapy, # of prescriptions, etc.) using acceptable methods that could
be admissible in a lawsuit.
As for help with expenses, I don't know what's out there. Unemployment
and/.or disability insurance, if you have any, may help.
This is all for discussion only. Your best bet is to not discuss facts of
the case or your injuries publicly, and instead ask your alwer these
questions in a meeting between just the two of you.
