Hello,
I've been separated from my husband for five years, not yet officially
divorced. Our income consists of his military pension, his disability,
and the disability paid to me for his disability (mostly for our minor
son).
As our three children (two of adult age) live with me, and I pay all
of our bills, I've had control of all of the income. He lives
rent-free, food provided, and no utilities. He just had his disability
payment sent directly to him, leaving me unable to pay my utilities,
our monthly debts, and even buy groceries. He is also threatening to
take all of his military pension.
He has a history of mental problems. He has been committed before, and
released on the condition that he follow treatment. He did not.
My first question: even though the majority of the money is in his
name, isn't it both of our income since we are still married? Also,
why am I responsible for all of the bills in his name, even if I knew
nothing about them?
I've called the Legal Aid in my county. I qualify for their assistance
based on the income that is solely in my name. But, they won't even
advise me as their case load is too high, and they aren't taking any
more domestics. Which is why I am here. I have no idea of where to
turn. I cannot afford to file for divorce, until my income is more
stable.
Can my husband legally do this? I cannot buy groceries. I cannot pay
the utilities. We will have loans default. I can't even think straight
enough to name all the damage he is doing. All I know is that my
children and I NEED that money. He doesn't NEED it...he never has and
never will pay his bills. The responsibility for that has fallen to
me. He tells me he is using the money to take a trip across the
country!
Please, please help me.
