Post divorce

After 12 years of marriage my husband said he wanted a divorce. We
agreed that we would separate and go through counseling. After about
8 months of counseling both of our counselors agreed that the chances
of our staying married were slim, as did my husband. Most of our
problems stemmed from his alcholism and he wasn't willing to make any
changes in order to save our marriage and we proceeded with the
divorce. Because of my confusion (amongst other things)at the time I
went with his advise and we had the same lawyer. We have been
divorced for approximately 2 years. I received a monentary settlement
of $25,000 while he retained all other assets. At the time my ex was
worth approximately 1.5 mil, which I didn't realize the full extent of
until a short time ago. At the time (obviously I wasn't thinking
straight) I went with what "our" lawyer said thinking that he was
looking out for my best interests as well.
Recently a mutual friend died and I called my ex to let him know.
After a very awful conversation he informed me that Doug (the lawyer)
had told him not to do anything stupid and to be nice to me until the
statute of limitations on our divorce was up. Information that I was
never given. I dug out my divorce papers the other day and noticed
that Doug states that he is the attorny for my ex, but doesn't say
that he was representing both sides.
I really feel like I've been taken (duh) and have heard that a lawyer
can't represent both sides in a divorce. Does anyone know if this is
true or not? I feel that the representation I received by him was
unfair and that my treatment was unjust. Do I have any recourse in
reopening my case and are there statues of limitations? I'm not sure
how the laws vary from state to state (I'm in Montana)and am not sure
where to turn or even if I have any legal right to pursue this
further.

Contact a lawyer today and see if you can go after that lawyer for malpractice
and to protect any legal rights. You could at the minimum get a bar complaint
lodged. Good Luck.
