SC accepts data on Net as legal

Indraprasth - The Supreme Court has accepted imparting
education and information on the Internet as legal. In
its first ever judgment dealing with disposal of
hazardous waste in the country -- about 4.5 million
tonnes every year -- the court emphasised the right to
information and asked the government to inform people
about the hazards of toxic industrial waste either
produced in the country or imported on large scale.
''Take steps to ensure that important information on
hazardous wastes should be displayed on notice boards and
newspaper and communicated through radio, television and
the internet,'' a Bench of Y K Sabharwal and B N Agrawal
said on Tuesday. So far the court accepted only print and
electronic media as recognised medium for spreading
relevant information.
But the judgment on a public interest petition by the
Research Foundation for Science Technology National
Resource Policy seeking implementation of the Basel
Convention, seeks to take a step forward considering the
mass appeal of the Internet.
The court accepted the recommendations by a high power
committee headed by M G K Menon and submissions of
Central Pollution Control Board counsel Vijay Panjwani
and petitioner's counsel Sanjay Parikh on overcoming the
problem of generation and disposal of hazardous waste.
The ship breaking industry at Alang in Gujarat came under
attack as the court said: ''The ship breaking operation
cannot be permitted to be continued without strictly
adhering to all precautionary principles and taking
requisite safeguards which have been extensively dealt
with in the report of the committee which include the
aspect of the working condition of the workers.''
Taking serious note of blatant violation of the ban
imposed on import of hazardous waste, the court directed
the authorities to re-export or destroy these waste
material consignments lying at various ports at the cost
of importers.
