It also helps to have an unbiased witness such as an officer.
I was involved with an insurance scam and had to appear in court.
The jerk tried to make the judge believe his passenger was injured and
had to be taken to the hospital while he had not a scratch on him. Funny
thing is, his passenger was skipping school and the officer when arriving
on the scene asked right off, "Is anyone injured?". The answer was no.
In my case, the other party called the police and proceeded to limp when
they arrived. It was actually kinda amusing, considering my car was
totalled and his car was barely dented.
Didn't matter though, because the police report found him 100% negligent.
This moron was obviously trying to commit fraud but instead got nothing
other than being dropped by his insurer.... I ended up getting a large
settlement from his insurer.
30 or 40 years ago, that little charade used to work on the cops. But not
any more. Cops have gotten wise to insurance and injury scams.
One time I was backing out of a parking lot space and played bumper tag with
a car coming around the corner of the building. The gal was all hot and
#@&@
in about the damage I did to her car. Not a scratch. The car looked
like it had seen enough war fare. We went through the process of exchanging
information. My insurance agent called me and said my rates were going up.
Six months later I got to see the gal's car again and it had been totally
restored.
Never again will I settle for that kind of bull#@($ scam.
At least you got to deal with an insurance company that was nice to you.
