1. How long does a landlord have to "charge" an ex-tenant for damage? In CA I
know it's something like 21 days. Does anybody know what it is in TX? Does 10
months sound insane to anyone else?
2. If no walkthrough is done prior to move in (or ever for that matter) how can
the landlord both charge a tenant for damage, and know what percentage of the
damage is the tenants?

I am a TX landlord and it doesn't sound insane to me. My last tenants trashed my
property several months ago, but I haven't found the time to fool with suing them.

It depends. For example, if a landlord installs new carpets just before his tenants
move in, then he videotapes the trashed carpets after they move out, I am sure he
can sue for 100% of the replacement cost.

trashed my
property several months ago, but I haven't found the time to fool with suing
them.
But 10 months?! That's enough time to rent to another party who can then
"trash" the place.

And he would have his receipts for the new carpet (dated, of course) to prove
this. Which would make perfect sense to me. The carpets I have been accused of
trashing were (according to neighbors who had lived in the subdivision since it
was new) the original carpets installed when the house was built, in the 80s.
We're talking threadbare on the stairs- scratched up by a previous tenant's
dog, the works. It's my word against hers, and I know full well she does not
have proof of replacing the carpets within the past 15-20 years. Guess it'll go
to court then, I'm not paying!

In Texas, landlords have 1 month to return a security deposit and
outline any damages they have taken out. If you've failed to do that,
you're going to have a hard time collecting anything.

Thanks! It's not me, but my ex-landlord who has appeared out of nowhere saying
I need to replace 20 year old carpet and appliances that I used for 2 years, 10
months ago. Do you have any specific references to laws that cover this? TIA!

Sorry, I don't. I know it's not the same thing as a law reference, but
the standard TAA leases wouldn't have this provision in them if it
weren't required by law.
TAA = Texas Apartment Association - you could try asking them, or HAA
(Houston) or GDAA (Greater Dallas) for a reference, but they're really
nothing more than a lobbying group for landlords. I'm not a tenant
there anymore so I don't know, but there may be tenants associations.
