Car title problems in Texas

I bought a car from an unreliable relative and got nothing in writing.
The relative got the money, paid the car off and had the title sent
to her. She will not sign the title over and continues to drive the
car. There was no contract. The car was bought with two checks. A
civil action against this person will probably not do any good, as she
has no money, property, etc. How can I get my title so I can get the
car legally?

I am not a lawyer, and this is not legal advice.
How much is the car worth? If it's within the limits of small claims court
in Texas, sue the relative for the title to the car. An oral contract
should be enforcable, and you have cancelled checks to support your
contention that you paid for the car. Unless the relative is willing to lie
in court, it should be easy. Were there any witnesses to the deal?

You can sue her, asking the court to order her to transfer the title to you
since, according to your facts, it seems you now hold "equitable title" and
she only holds naked "legal title." But before you do anything, I suggest
you call your local tax assessor or the Texas Dept of Transportation and ask
them what, if any, mechanisms there are under TX law that might make this
simpler for you.
