We went to a resturant where the service was so terrible, that I left them a -10 cent tip, food was spilled on us and the service was pretty bad. My friend tells me I could be arrested for theft, I submit they should pay my drycleaning bill. The manager didn't seem to care about our complaint, so the -10 Is this theft or not?

IMO, not. Theft is unlawfully appropriating property with intent to deprive the owner of the property. Based on your post, you had no intent to do so, but were deducting an amount to offset damage done to your clothes and for failing to deliver services in accord with your reasonable expectations. They might have a civil claim for breach of contract, but you could counterclaim

We'll probably never find out in this forum, but I'd love to know what the charge reflected on your next credit card statement is. I be willing to bet that it will be $51.50. To generate that initial slip, they put in the $51.50 amount. I'm pretty sure the rest of the system isn't set up for a negative tip amount, so they probably just totalled it out as if you hadn't left a tip. Tony

Ah... Well, I've never heard of any ability to "Negative Debit" a Credit Card Charge, but I guess You were there and I was not... If it had been me, I simply would have Caused a Stop Payment/Charge Back with my Card Issuing Bank for The Full Amount of the Unsatisfactory Transaction... Spill Soup on me will ya?!? This is the best answer, though I disagree that there was no crime. Stealing 10 cents from a restaurant is theft of services. You probably wouldn't be prosecuted, not just because it's only a freaking dime, but because of the "negotiated settlement" answer.

Actually, the initial slip reflects just a "pre-approved" amount, along with a Transaction ID. When the actual "accepted" amount (including tip) is processed for the Transaction ID, the "accepted" amount replaces the "pre-approved" amount. So, if the cashier agreed to the negative 10-cent tip, then $51.40 should be the processed amount. If it does show up as $51.50 on the statement, then it can be disputed with the credit card company since the receipt would provide proof of the "accepted" amount. This scenario, IMHO, would make the restaurant the thief, and they would easily be in violation of the credit card company's T&C. Just my 2 cents (3.6 pence) worth...
