Insurance cancelled, found out on day of fire

I paid my insurance late, sent it through the mail. Today there was a fire in
the kitchen, and today in the mail I got a refund check of the insurance
premium saying they were returning my money because payment was received after
the fact. I had no idea they'd cancelled the account since they took my
payment. Legally, am i screwed? I mean, they took my payment, they cashed my
check. Can they be made to pay? I haven't contacted them yet about the fire. is
there anything I can do?

Insurance law varies from state to state. Some states provide that a
policy cannot be cancelled by an insurer unless it takes a number of
very specific steps. It's possible your insurer did not take those
steps, assuming your state requires them.
Document everything very carefully. Consult a lawyer if you can. I
would not advise waiting very long before reporting the fire. You
could violate the reporting requirements of your policy by waiting.

Some states, like California, have governmental agencies that may be
able to help you figure out what your rights are. You should also
read the policy to see what it says about cancellation.

Check with your state's insurance commission. If you get a negative
answer, check again with an attorney.-Jitney
