I may be under investigation for misdemeanor indecent exposure and am looking for a consultation. I will provide the details here. (note that this is in California) Last Thursday, Feb 5, at approx 3:30 pm, I was driving with my convertable top down. I am a herpes sufferer, and had an outbreak about a month ago. After I found nothing and calmed myself down (this was no more than a few minutes), I drove away and went home. A few hours later, 3 police officers came to my door and questioned me. This is the first time I had ever been approached by the police for anything other than a traffic ticket. They explained that someone saw me pull over and do 'something' I should not have been doing (I assume whoever saw me thought I was masturbating). The officer also told me that the witness took pictures. However, since the witness clearly saw my license plate and called police, I have to assume they were somewhat behind me and had an obstructed view of what was actually occuring. Of course, I fully understand why someone would think what was reported, but I explained to the officers what had happened. They asked if I had proof of my affliction, and I told them that I did not but that I could probably get it from the clinic where I was diagnosed. I also offered to show them my perscription medication but they said it was unecessary. After listening to what I had to say, they said I might be contacted. I don't know if what you did is a crime. I am not a criminal law attorney, so I won't speculate on that. But if what you did is a crime, I don't believe that your incentive to do it will be any defense. So you told the police all about it, including your confession of the crime, along with your story about innocent intentions. If they didn't have enough evidence before, they do now. (Or they will if you repeat the confession after being read your rights.) Apparently you didn't learn the lessons Perry Mason taught. So what to do. Wait for the charges. If there are charges, hire a defense attorney. If there are no charges, learn three lessons: One: a compulsion to examine yourself in public is not a defense to a charge of indecent exposure. Like whenever I watch old reruns of Columbo, he always knows in the first five minutes who did it. Well, I'm glad that at least a FEW of the follow up posts had something to do with my question. First of all, I only posted this to misc.legal and misc.legal.moderated, so if it was crossposted further I don't know how. I had thought that perhaps the cops might be lying about the pictures, it seemed very unlikely that in the short time I was there someone could have seen what was going on and found a camera. I spoke to an attourney and he said that nothing I admitted to the cops could be used against me because I had not been arrested and not been read my rights. Is this accurate? At the time I did consider not saying a word to the police, but obviously someone saw me do something, so refusing to speak would have looked really bad and perhaps would have led to a trip to the station - in which case I would have definitely had to hire a lawyer. I'm really curious to know if keeping your mouth shut duing a routine questioning is as important as keeping your mouth shut after you've been read your rights...

One more thought... Ok, I admit that a lot of what I have in my head about dealing with police has come from NYPD Blue. Go ahead, laugh if you want, but that program is based on the experience of an actual NY detective. In any case, that show has shown and taught me the lies and deceipts that detectives will use to get you to confess once you are in custody. If I had been brought in for questioning, I absolutely would not have believed anything they said to me (especially about having pictures) and would have gotten an attourney. However, when uniformed, non-detective officers showed up at my place to get my side of the story, the same warning system in my head had not gone off. I mean, is it their job to play detective too? To lie and coerse a confession? And, once again, is anything I said to the uniformed officers admissable?

In California, isn't there a requirement that the indecent exposure be performed "willfully and lewdly"? There are plenty of cases involving nude sunbathers and the like where the absence of lewd intent was a successful defense. Since a conviction for indecent exposure (PC 314) in California carries a lifetime requirement to register as a sex offender (PC 290), the OP is in a position of needing very badly to come out with nothing worse than something like disorderly conduct. And since a second 314 is a felony, the OP also needs to get good enough care that he won't be in a position of feeling like he needs to do anything like that again. If he handles this badly, it could turn into a life-ruining experience. Maybe if the OP has convincing medical and psychological backup for his story, it would cast enough doubt on lewd intent that the DA wouldn't pursue it and would entertain a plea bargain. This sort of deal takes a lawyer to present and work out and may well take expert testimony. I don't see it being anything less than disorderly conduct, no matter how the OP spins it, unless they really don't have any evidence. The importance of McGyver's advice to hire a defense attorney, when or if any charges come out of this, cannot be overemphasized. Not sure where that attorney is getting his information from, but it doesn't square with what I've heard. Voluntary statements, which is what you made, can be used against you. Miranda doesn't apply until the situation is custodial (e.g. you're arrested). Deception (police claiming they have evidence they really don't, for example) generally doesn't make a voluntary statement inadmissible, either. Keeping your mouth shut and speaking only when advised by your attorney when there is a significant charge involved (and indecent exposure is a significant charge in California, because of the sex offender registration consequence) is a really good idea. -- Not a lawyer, Chris Green
