Crawford, Texas (AP) -- An attorney for five peace activists says his
clients weren't demonstrating when they were arrested in Crawford
during a visit by President Bush.
The five defendants and about 100 other people were on their way to
Bush's ranch in May when they ran into a police blockade.
They're charged with violating the city's parade and procession
ordinance.
In their trial Saturday, their attorney says they weren't holding
signs or chanting when they were arrested.
He says they were trying to get information about another person who'd
been taken into custody.
Crawford Police Chief Donnie Tidmore testified that a person wearing
political buttons without a permit could violate the city ordinance.
He says he's never turned down a request for a permit.
The protesters would have had to give him 15 days notice and $25 for a
permit.
First of all, I don't believe the ranch is within a city limit.
secondly, there are no laws prohibiting the use of the roadways in an
orderly manner by any number of vehicles.
If it is a city ordinance, then the ordinance is in violation of
constitutional law. State and federal.
Wearing a campaign button without a permit?
Unconstitutional. Violates the "freedom of speech" clause.
Many well meaning city officials who have no legal background, have laws
written which are designed for one thing, to make the city money.
Because the small communities are tightly knit together, friends are less
likely to engage a legal battle.
Nonetheless, the law is illegal and unconstitutional.
But the story is always good humor.
