Last week I was fired for getting into an accident with one of
the company
vehicles..I dont have a problem with that, but here is what I do
have a
problem with..
After the accident they continued to allow me to drive for two
days, mon and
tue. Unknown to me they had placed an ad in the Sunday paper
for my
position..On Tuesday my manager talked with human resource and
they acted
like they were attempting to save my job.. I drove on that
Tuesday.. On
Wednesday they fired me, the excuse was that I had placed a dent
in a
trailer a few months earlier as well as the accident and they
said I was too
much of a liability. Let me remind you that Sunday the ad was
placed and on
monday and tuesday I was allowed to drive, they knew on Sunday
they were
going to fire me..
Do I have a case against them???
You seem to be focussing on the idea that the company's stated
cause for firing you was hypocritical, since you are a good enough
driver that they kept you driving Monday and Tuesday after making
the decision to fire you, and then claimed that unsafe driving was
the cause. But that focus would be valid only if the company
needed good cause to fire you. If the employment relationship was
at-will, meaning the employer had the right to fire you without
cause, then it doesn't matter whether they told the truth about
the reason. If the company needed good cause to fire you,
because of a union contract or employment contract or whatever,
tell us about it.
