credit card fraud

Without my knowledge or permission a sibling opened a credit card under my
name. (please no self righteous condemnation etc)...what I need is good
legal advice....We are talking a sizeable debt that I had no knowledge of.
The sibling has no assets to speak of. If I file a fraud claim against the
credit card company (BOA), what will be the turn of events?
Obvisouly I don't want to put my sibling in jail for fraud but bankrupcty
filing may the sibling's response or perhaps a settlement?.
Legal advice please.....
Mango..

I'm not a lawyer, this does not constitute legal advice.
You basically have 2 choices:
1) don't report the fraud and be liable for the credit card debt, or
2) file a fraud complaint and (hopefully) not be financially liable.
There really aren't any other options, assuming that your sibling can't or
won't take care of the debt. When you file the fraud complaint, your
sibling will most likely be arrested and charged with credit card fraud,
identity theft, and whatever other laws might apply.
Keep in mind that, while unfortunate, it's not your fault that your sibling
made a stupid decision to do something illegal, and there's no reason why
you should pay for that. It was his/her choice, and he/she should bear the
brunt of the consequences for that choice.
