auto insurance co. going out of business.

Hi
Last year I had a minor parking lot accident , both me and the other car
back into each other and I broke the other car tail light.
I gave the lady her my insurance information (she refused to give me her)
because she claims that she stopped and I kept on going.
Well few days ago she call me saying that my insurance company (superior
insurance) is refusing to pay her saying they are going out of business. I
paid them my coverage up until today. So I am suppose to be covered. When I
called myself to them I couldn't get anyone to answer the phone.
I want to know what are my rights, I had an insurance at the time of the
accident, and for that matter until few days ago.
Can she sue me? I offered to pay that damage of $475 but I don't want to pay
her car rental. I never approved for that.
Please let me know what can I do.

Call your state government's Department of Insurance. They should have a
program for covering the claims of defunct insurance companies.

Call your state government's Department of Insurance. They should have a
program for covering the claims of defunct insurance companies.

I am from California, should I call or I should give the lady the phone #
and she will deal with them.

Since it is your insurance policy, I think you should call; they may need
cancelled checks, etc. as proof of insurance.
www.ca.gov is the generic website for all California government agencies. Off
the top of my head, I don't recall the name of the division; it may have been
something like Insurance Guaranty Fund. Ca.gov will get you to the Dept of
Insurance, and from there you can poke around the cubbyholes to see what sounds
like the right division.
ISTR that it was limited to whatever the minimum policy limits were; since
you're only dealing with a minimal claim, that wouldn't matter much to you. If
you'd creamed three pedestrians and a sculpture garden, that would be another
story.

That may be true, but it's her claim, I'd make her do as much of the
work as possible.
It's also not clear to me who was at fault here. The guy should never
have let her get away without exchanging information. Isn't that
required by law in all states? (I know it is in some)
If she had refused to exchange with me, I'd have called the police.
