Judge jumps all over Hurlbert

State District Judge Terry Ruckriegle said the underwear -- worn by
the accuser the night of the alleged attack and the next day when she
went to a hospital for an examination -- must be turned over to the
defense within 24 hours.
"The court finds the prosecution's refusal to turn over the evidence
to be without merit," he said.
The prosecution turned over all other physical evidence by Saturday's
deadline except the underwear. Defense attorney Hal Haddon said the
material includes three samples of semen that don't match Bryant.
Prosecutor Mark Hurlbert objected at that point, and the conversation
ceased.
"The judge really jumped on Mark Hurlbert and you can't blame him. We
heard Hurlbert's argument and it seemed petty, obstructionist,
defensive and dishonest. It appears that the DA is afraid of the truth
and that's unusual position for a prosecutor to be in," said 7NEWS
Legal Analyst Craig Silverman.
"I think (Hurlbert) is doing everything he can to protect the alleged
victim. Obviously, this DNA analysis can only help Team Kobe. It will
reveal the possible presence of other sexual partners. Clearly, it's
the position of the prosecution that even if they find other semen or
sperm, it's not relevant but that doesn't give them to give any reason
to go against a court order and deny access once the judge has ordered
it disclosed," Silverman added.

Not so unusual. This is America, land of the free and home of the
shyster. Prosecutors and cops aren't so partisan in Europe, where
trials are investigations for determining the truth, not totally
controlled by the adversarial parties.

Here, most of the trials and prosecutions are to meet their quota of how
many they have successfully sent away, or the prosecutors to satisfy
their own ego, not to find the truth.

I hope the prosecutor ends up in jail. This case seems awfully fishy. I hope
Kobe can put a civil suit on him after the trial. Even if Kobe looses he can
make this guy go broke.
