In a written motion filed today when court was in session, Haddon offered several reasons why the woman's sexual activity shortly before and after her encounter with Bryant is relevant and should be an exception to the rape shield law: There is evidence that the accuser engaged in multiple acts of sexual intercourse within the two days preceding and less than 15 hours following her encounter with Bryant. There is "factual similarity" between those acts and the circumstances of the accuser's sexual intercourse with Bryant. The acts also show the "accuser's knowledge, intent, common plan, pattern and modus operandi with respect to whether she consented" to having sex with Bryant. There is evidence that the woman had sexual relationships with two prosecution witnesses. The sexual history between the woman and those witnesses is relevant to their credibility, Haddon said. Ruckriegle spent much of the morning chastising prosecutors Mark Hurlbert and Dana Easter. The judge took exception to Hurlbert questioning an order Ruckriegle issued weeks ago, stipulating that all physical evidence be turned over to the defense for testing. Ruckriegle also was upset that Easter waited until Friday afternoon to file a motion asking the judge to limit questions the defense will be permitted to ask the alleged victim Tuesday during the rape shield hearing. The only bright spot for prosecutors came when Bryant bodyguard Troy Laster testified during part of a hearing on whether statements Bryant made to investigators July 1 should be suppressed because he was not read his Miranda rights. Laster, an off-duty LAPD officer, did not have a clear recollection of many details and his testimony did not appear to help Bryant's assertion that he believed he was in custody at the time of the interrogation.

Yeah but...correct me if I'm wrong, but this would only affect blood typing and would not affect a DNA test in the least. And as far as I know, DNA tests are being used for all samples in this case. One person can have different DNA in different parts of their body c.f. chimaerism and mosaicism. The most confusing cases would be where two non-identical twins merge during development. It would be possible for the blood and semen of a suspect to be quite different. The blood could even be female :-)
