Kobe bill would criminalize adultery

LANSING -- "You can't legislate morality."
That's what the former director of the state appellate defenders
office, F. Martin Tieber, said about a proposal by Sen. Bruce
Patterson, R-Canton, to treat adultery as a form of criminal sexual
assault.
"The bill is about accepting responsibility and not taking advantage
of others," Patterson said.
His so-called 'Kobe Bryant bill' addresses the presumption that either
party involved in a sexual encounter outside of a marriage did not
consent to the sexual activity. It's nicknamed for the married Los
Angeles Laker's co-captain who is accused of raping a woman in
Colorado.
Julian Cook, a professor at Detroit College of Law at Michigan State
University, says he sees both sides of the issue.
"Proponents might argue that prosecution is necessary in order to
assist prosecutors in their noble efforts to convict the perpetrator
of such heinous crimes," Cook said. "Opponents might contend that the
proposed rule might encourage the prosecution of otherwise innocent
individuals."
Depending on the level of violation, criminal sexual conduct carries a
penalty of up to life in prison.

seem to me that this vague wording holds both parties guilty of rape,
although it seems unlikely that the women will never be arrested or
tried for it.
