I'm a pro se plaintiff in a medical malpractice
case in New York.
I've conducted extensive depositions of the defendant
doctors, but the doctors on instruction of their
attorneys refused to answer many questions.
I then filed a motion to strike the defendant's
answer based on refusal to comply with discovery.
The problem I am having is the jugde will not
rule on the motion, and almost a year has elasped
since I filed the motion.
Any suggestions on what I might do?
Thanks
Jeff

Why didn't you file a motion to compel the doctors to answer the questions?

Well, that's a good question. I was originally planning to do this,
but then I started having some personal difficulties that prevented me
from spending the time on redoing all the depositions.
Also, since they have my questions, they can prepare carefully worked
out (attorney prepared) answers in advance. I think this would defeat
the purpose of getting spontanious (somewhat honest) answers to questions.
