I missed my jury duty date and they want a resonable explanation as to why I should not be penalized for missing it. I just forgot about the date but the clerk said that is not good enough. They are sending me a letter in the mail and when i receive it i have to write back with a valid reason. does any one know an excuse that should work? thanks for the help!

PARTICULARLY in light of your Frantic Attempt to Right the Wrong, which is, In And Of Itself, about as sure an Indicator as can be that you Did Not Obstinately Refuse to Perform Your Jury Duty... which is The ONLY Reason for which One Can Be Punished... Feel Free & Confident to Inform The Court that Due To Your HECTIC Personal & Employment Schedule, you Simply Forgot a Date which comes up Very Rarely in the Life of The Average Citizen... Er. . .note that Martha Steward is going to jail because she lied under not-too-dissimilar circumstances. If she had told the truth, she would have been fined the equivalent of a few day's legal fees. Regards Old Al

The clerk's generally don't know nuthin or have any authority to say what is and what is not acceptable. You could always say that you did not get a notice to report for duty. Who's to say you did unless you signed for the letter?

The jurisdiction most likely has a presumption that if it was sent, then it was received. IOW, it doesn't have to prove you received the notice; you have to prove you didn't.

Different locales treat this differently. Los Angeles has been coming down hard on jurors failing to report, to the extent of levying $1,500 contempt-of-court fines. Some other places (Houston, apparently) are accommodating and will allow you to reschedule. -- Not a lawyer, Chris Green
