[Note: My reply-to email information is included below. This posting was done through an anonymous remailer to avoid my e-mailbox from being bombarded with huge virus-containing spam emailings to the over-capacity state.] This is a Morris Co., New Jersey case for which I seek representation by a N.J. licensed civil rights/constitutional law attorney. Late last year, in the middle of the night, I was yanked out of bed by town police and coerced into getting into an ambulance to be taken to the emergency room of a hospital in another town for an unfounded psychiatric evaluation. First, let me tell you what had NOT been happening that night. I was not on a window ledge threatening suicide. I was not brandishing weapons and threatening anyone. I was not carrying explosives nor making bomb threats. I WAS IN BED TRYING TO SLEEP! Now, for your consideration, I include the addendum to the Notice of Claim which I submitted to the town: -*-*-* Addendum to P.M.'s Notice of Claim starts here -*-*-* I was subjected, by [town] police (and their EMS associates), to: 1.) Illegal breaking and entering. 2.) Illegal search and seizure. 3.) False arrest and then later abandonment. 4.) The reckless abandon of the police who improperly acted without a formal complaint, arrest warrant, search warrant, nor probable cause. 5.) Threats, coercion, intimidation, and humiliation (specifically that I'd be put in handcuffs, that I'd be taken away in a state of undress, that I'd be carried out, that I'd face a certain criminal charge, and that the EMS people would forcibly bind me to a gurney and take me out) amounting to total tyranny thereby violating my Ninth Amendment rights. 6.) Manhandling and the further mistreatment of being forced to leave my apartment hurriedly and go out into the very, very cold night air with just a thin nightshirt on, and then later, being required to submit to a urine test and an invasive (needle stick) blood test without my consent. 7.) The humiliation of having the police fail to use common sense and see through a ridiculously blatant lie that I "was kicked out of every hotel in [town]." 8.) Being penalized for trying to preserve my Fifth Amendment rights which I made perfectly clear to the EMS people, but to no avail. 9.) The failure of a police detective who was on the scene to speak the voice of reason, maintain order, and prevent the intrusion of additional unauthorized people into my apartment which made for a circus-like environment. 10.) The failure of Police Headquarters to speak the voice of reason and see to it that proper, legal procedure was adhered to. 11.) Wanton recklessness with nary a care for the well-being and constitutional rights of this claimant. 12.) Failure of the Town to properly recruit qualified law enforcement agents, to train their agents, and to supervise their agents. 13.) Abandonment in [town 2], NJ, quite a few miles from home to fend for myself on a cold winter's night in the wee hours of the morning to make my own way home. 14.) Having to deal with the great inconvenience of clearing up the issue of the invalid billing of hospital [non]services to me. 15.) The refusal of the police to honor the request of the only person who would be the logical complainant in the matter, C.D., to drop the whole thing. Rather than honor her request, the police threatened to take her away involuntarily, too! (Note: the only criminal charge that the police alluded to was elder abuse, and so that would make Mrs. D. the only possible complainant in the matter, but Mrs. D. didn't even raise elder abuse on my part to begin with.) Lastly, this claimant alleges that he was subjected to harassment and retaliation amounting to the felony of obstruction of justice under the U.S. Code. -*-*-* Addendum to Notice of Claim ends here -*-*-* I am also pursuing a claim against the hospital on the following grounds: breach of fiduciary duty, false imprisonment, fraudulent billing, coercion, intimidation, and aiding and abetting false arrest among other things. By the way, there was no psychiatric evaluation that night. The cops didn't even bother to show up at the hospital. They just ducked out somewhere along the way. However, the hospital didn't miss an opportunity to take invalid jurisdiction over me and breach their fiduciary duty to me while leaving me in a high state of anxiety and humiliation while falsely imprisoning me there.
