I have a question and my hope is that you know the answer. Several
years ago I defaulted on a credit card debt while in college. They
sold the debt to a collection agency. Now the original debtor is
bringing suit against me. We've signed an agreed upon payment plan.
The lawyer said I can call at any time with an offer and he'll try to
broker a settlement with the origianl debtor.
Question: Can I simply contact the original debtor and make the
settlement offer directly and hope that they'll dismiss the suit or is
it too late since I've signed the agreement. Can the original debtor
dismiss the suit after an agreement has been signed? Basically, I
feel like I'd have a lot more flexibility with the original debtor.
