Toronto file a defence (form 9A) and a pre-trial request (13A) over a
suit filed against him. Here's the gist:
After a brief verbal altercation (not denied) the plaintiff pulled a
weapon and chased the defendant. Police were called and the plaintiff
was apprehended and charged. The nature of the charges are not yet
known, we've filed for a copy of the police report for that day. The
defendant was not charged with anything that day and was asked if he
would appear in court if needed.
The plaintiff has filed for mental damages, stress, and costs related
to defending himself against whatever charge(s) was laid that day
($10000 !!). We filed the defense and stated it would be based in
part on the police report of the incident and asked for complete
dismissal.
Now, however, the defendant was delivered papers from a Justice of the
Peace, charging him with threatening death and a court date has
already been set.
Any ideas how to get out of this mess? Understanding that a lawyer
will probably need to be consulted, but nevertheless...
