hello, I have a question regarding the collecting agent for unpaid bill. I went to a unviversity in 1997. I took some courses but late I dropped it. I didn't received any tuition bill. But most recent after 7 years, a collecting agent called me and said that the university just send them the bill (~$2000) and asks them to collect it. If I don't pay, they will send the information to the credit center. Someone can help me to deal with this kind of colleting agent. After 7 years, I even don't have any evidence for my previous course and tuition. Why didn't they ask me in earlier year? I remerber that even some civil cases have the time limitation. After a certain time, it will pass the valid time, you cannot sue the person anymore. How about the unpaid bill? After 7 years, can they still ask me the bill? I appreciate it if you can give me some suggestion. Thanks.

Bull#@($! Why did the university not try to contact you first? This sounds like a casse where an agent went looking for business and found some. Check your state laws on "statute of limitations" for collecting debts. Perhaps if the state was known here, someone might be able to give you some better clues.

The university can rely on its status as a unit of State government that can get away with more than a private entity. They can claim you owed the fee all along and couldn't find you. Call the university collections officer (yes, they have one) and talk nicely and ask what you can do, but don't cooperate with an outside collection agency unless the officer explains convincingly that you must. It is also very possible that the "agent" is really the same as the university collections department.

First, ignore the collection agency. They might lose interest. That's possible in a small claim seven years old. If they become impossible to ignore, write to them and tell them to not contact you in any way. Use certified mail, Return Receipt, and keep a copy of your letter. But don't do that until you can't stand it any more. That's because the statute of limitations might be still running. If they sue, or if the suspense is driving you crazy, do an internet search for the statute of limitations pertaining to written contracts in your state. If you find that the statute of limitations has run, the next question is whether your state tolls (suspends) the running of the statute for the number of days that the defendant is out of state. If after all of that you find that the statute has run, you have a good defense. If the statute has not run, then see an attorney to defend you when they sue, or learn enough to do it yourself. If you decide to defend the case yourself, tell us all about it, and maybe we'll have some ideas. McGyver
