Perhaps someone more qualified than I can answer this, but has not this
plaintiff, himself, as evidenced in the Google archives, posted links to
Google's archived copies of other poster's messages and content? Why
would a commercial business use any tool or service of another business,
if they they claim that tool or service violates their own rights?

To be precise, between 1 Jan 2004 and the 13 June 2004, "Ray
Gordon"/"LeModernCaveman" posted every 1 hour and 26 minutes (16 times EVERY
day!)

Ray wants Google to stop archiving his USENET posts.
But he said to me about something I wrote,
"The truth is that people get sued pretty harshly for what you've been
pulling on me. You also have called yourself a shill, and like it or not, I
can quote that with impunity."
Can Google also quote his USENET posts with impunity?

He's done more than that.
He's actually re-posted several of my posts in other newsgroups for comment.
