My son purchased a vehicle through a credit company called Credit Acceptance Corporation. Apparently there he is having some sort of issue with the Credit Company, and they have been calling my home for weeks now. I relayed messages to him, and he has not apparently contacted them. In any case, he and his wife moved away leaving no phone number or contact address, and I have told Credit Acceptance Corporation he no longer lives here and that I have no contact information for him. They will not stop calling. Finally, tonight, I told the representative that if the phone calls did not cease, that I would take legal action against them. She told me that because he had given my phone number as a contact number, that they would not stop calling my house until my son instructed them not to do so. They are HARASSING ME FOR MY SON'S DEBT, and I cannot get them to stop. I even called up their 800 number, and they said that they will not stop calling. When I asked to speak to a supervisor, they said that there were none there. HELP!!!!

I believe according to the Fair Debt Collections act it's illegal for a collection company to talk to anyone other than the debtor unless he specifically tells them they can. Unfornately not. The Federal Laws only protect people from unfair tactics by "third party collectors", not the original creitors, themselves. According to the law, you MUST tell them EXACTLY these words. """ADD ME TO YOUR DO NOT CALL LIST""" In your case, I would tell them that tbey have the wrong number, and then say what I typed above. I know that it is LAW that if you tell someone to ADD ME TO YOUR DO NOT CALL LIST, they MUST not call you again, or they are liable for prosecution. I used to work for a marketing firm, and I know this for fact. If they DO call you after you tell them ADD ME TO YOUR DO NOT CALL LIST, you need to contact the National Do Not Call Registry. They have a website, but I can not recall their URL. Maybe someone else can post that.

Try this. Get a police or refereee whistle. Whenever they call, tell them: after the count of 3 I am going to blow a very loud whistle into the phone. Count backwards from 3, and then blow it and keep blowing it, then hang up. Do this every time they call. After awhile they will stop calling. Or this: Get caller ID and every time it's them just pick the phone up and immediately hang up. After awhile they'll give up. Or this: contact the attorney general of your state and report them, and ask what can be done.

Sue their asses in small claims court for intentional infliction of emotional distress, invasion of privacy, and general harassment. Be reasonable in what you ask for damages, but ask the judge to award you punitive damages on top of compensatory damages.

I'm curious though.. I wonder if the people calling him, 'credit acceptance corp' is actually a 3rd party collection outfit. I know of one, 'asset acceptance corp' that's a 3rd party. Maybe the debt's already been sold.

It might help if you send a certified letter to a rep of the collection agency notifying them that your son moved and left no forwarding address. Continued attempts at calling will result in harrassment. If you had no participation in this debt, they can't call to harass you!

DNC list laws specefically exempt companies with which you have a busines relationship, which is,I'm sure, what this company will claim. Perhaps the best thing to do is notify the police and phone company that you're being harassed, and ask for their help. Also, you can see if your phone service has the "call blocking" feature, which allows you to block specific phone numbers from ringing through.

I've had this problem before. Get a recording of nursery rhimes, farm animal noises, musak, or any mindless B.S. you can think of. When they call, tell them, "I've told you he's not here, and I don't know where to find him. So here's some free entertainment." Then play the recording, set the phone on the speaker, and walk away. Come back after a few minutes and hang it up. Time is money, and sooner or later they will give up. They are hoping that he is there and you are screening their calls for your son, and that you will get so tired of their harassment that you will tell your son to deal with them or else. Many people lie about these things so they won't believe you. So "fight fire with fire," and play that noise they don't want to hear. If they call back, repeat as necessary.-Jitney

You are correct. I forgot about that exception. However, I believe that is you tell them ADD ME TO YOUR DO NOT CALL LIST. they must still honor your request, regardless who they are. You just cant get assistance from the DNC program. Also, for the OP, this is YOUR phone, and YOU are in charge of who calls. There are other legal means to stop HARASSMENT calls. Remember the key word is "harassment". If you were the person who is the debtor, there may be legal means by which these companies can continue to harass you, but if the party who owns the debt does not live at your address, then these are simply harassment calls. Even if the person did live at your address in the past, they no longer live there, and you MUST be sure to specifically state that they have a WRONG NUMBER, then tell them the magic words above. If I were you, I'd tell them this. YOU HAVE A WRONG NUMBER THERE IS NO SUCH PERSON AT THIS NUMBER ADD THIS NUMBER TO YOUR DO NOT CALL LIST If they start giving you crap about so and so owes money, etc. REPEAT YOU HAVE A WRONG NUMBER THERE IS NO SUCH PERSON AT THIS NUMBER ADD THIS NUMBER TO YOUR DO NOT CALL LIST Then state "IF YOU CALL THIS NUMBER AGAIN, I WILL PROSECUTE". If it happened to me, the next time I would say: "Sure I know where my son lives, but I am not going to tell you!" Then I would say: "I am rolling in wealth, but I am not going to pay the boy's debts!" Then, I would start laughing. Big loud horse laughs, directly into the phone, over and over again, loud raucous laughter, until they hung up.That might not stop the calls. Then again you never know, they might decide its not worth the effort.. And it would be lots of fun.
