Fat chance. In such a case, all evidence that the Eagle County Sheriff had in its possession upon which it based its decision to arrest would be made very, very public. That includes the infamous taped confession by Kobe, wherein he said that these kind of situations are commonplace in the NBA, and he named Shaq by name in that context, along with other teammates, like Rick Fox. Notice how both those guys are gone now. No way will Kobe, the Lakers, or the NBA stand for any of that. Kobe is going to *try* to quit while he's ahead. The victim won't let him though. he's going to have to spend *another* $20 million at least before this is all over for him.

Kobe would have a good case, considering the sheriff went around the DA's back to arrrest Kobe, even after they agreed they would wait. They broke their word. And the DA filed charges 2 weeks before the DNA results came back. Meanwhile, the detectives did a horrible job with the investigation. They didn't even completely investigate the "crime scene", which would have either corroborated or contradicted her story. Plus they refused to interview anyone who disagreed with the accuser's story, like the night auditor. Plus their search warrant wasn't supposed to take place at night but they did it anyways. And they took more items of clothing from Kobe, than they were allowed to take. And they apparently modified the tape. Not to mention, holding back evidence for half the year. In this case how could it even be possible to prove innocence? He admitted being there, what proof could there be other than a video tape of consent being given or a total recantation by the alleged victim? The first scenario obviously won't happen. If the second one occurs would it automatically mean the arrest was wrongful? From a legal standpoint, I think no, the DA theoretically could have had just cause acting on what it believed to be credible evidence. I'm not a lawyer but I think it would not exactly involve proving his innocence. It would be showing that he was arrested without cause which involves things like what evidence was acted on. ,Bob Koca
