Experts say Kobe tape not incriminating

"The jury would not have liked the fact that he seems to indicate that he'd
like to settle this and then he also talks about having done this before
with another woman," said former prosecutor Karen Steinhauser, a visiting
professor at the University of Denver College of Law.
"He's somebody that had a very squeaky clean, kind of all-American image.
And what this tape does is definitely hurt that image," Steinhauser said.
"Does it incriminate him in terms of being a rapist? I don't think so."
Larry Pozner, former president of the National Association of Criminal
Defense Attorneys, said the main goal was probably to keep Bryant's T-shirt,
which was stained with the woman's blood, out of evidence.
"The single most important fact in Kobe's statement was that she kissed him
at the door when she left the room," he said. "That alone would be the ball
game for many jurors. You seldom find your rape victims kissing assailants
goodbye."
Sports marketing consultant David Carter of the Los Angeles-based Sports
Business Group said the leak could hurt Bryant's image and ability to win
corporate sponsorships, at least for the near future.
"It's devastating right now," he said. "But it's far better to have this out
now when his image is in tatters than to have it come out two years from now
when his image is being rehabilitated and his marketability is returning."

Is Pozner so dense as to think a man accused of rape would never
lie, or does he just think the average juror is?
