just wondering i heard about a guy who was charged with that for
spritsing some photographers
sounds kind of extreme is there "assault with a non-deadly weapon"like
if you use pepperspray?

Depends on how 'deadly weapon' is defined. In Texas, a deadly weapon is
defined in part as 'anything that in the manner of its use or intended use
is capable of causing death or serious bodily injury.' Theoretically, almost
anything could be used as a deadly weapon.

This sounds like an assault. Can you post a link or other confirmation of
the "deadly weapon" part?
