http://www.nytimes.com/2004/10/09/national/09kobe.html EAGLE, Colo., Oct. 8 - In his first comments to the police on the night he was accused of rape, the basketball star Kobe Bryant was scared about what happened and may have conceded lying to detectives, according to the transcript of a tape recording made then and released on Friday by the Eagle County District Attorney's office. In the recording, which was of such poor quality that large sections are garbled, Mr. Bryant says that he and the woman had sex. "I did have sexual intercourse with her," he said, according to the transcript. A detective then asked a question, the first part of which is inaudible, but which ends with the phrase "lie to us?" Mr. Bryant responded, according to the transcript: " 'Cause, 'cause I was scared, you know." The full transcript of the interview was not released, so it was not clear what previous statement or possible lie Mr. Bryant and the detectives were referring to. The documents underscore how much the prosecution was intending to rely on the recorded statement, which was made before Mr. Bryant's arrest. But in the many pages of analysis that accompany the partial transcript released on Friday, it was also clear how much the tape would have been a battleground had the trial gone forward because of the gaps, noises and garbles. One of the sound technicians who analyzed the tape for the prosecutor's office wrote in his report that the interval, disrupted by a cough, that precedes the words "lie to us" was consistent with the phrase "Why did you." But those words are not on the tape and would not have been heard by the jury. The document release on Friday ultimately did little to clarify the deep and murky ambiguity of what happened between Mr. Bryant and his accuser. One witness who was scheduled to testify for the defense and was interviewed by an investigator for the prosecution said she was working at the hotel on the night of the incident, and saw the woman about the time she would have come from Mr. Bryant's room. The witness, the transcript said, described Mr. Bryant's accuser as "smiling" and "bubbly." "That's not the attitude you have when someone gropes you, assaults you or whatever," the witness said, according to the investigator's report.
