FCC Chief Says Cannot Block Anti-Kerry Show Thu Oct 14, 2004 WASHINGTON (Reuters) - The U.S. Federal Communications Commission cannot stop the broadcast of a show critical of Democratic presidential candidate Sen. John Kerry's anti-war comments after returning from Vietnam, the agency's head said on Thursday. Sinclair Broadcast Group Inc. plans to air the "Stolen Honor" documentary which accuses Kerry of betraying fellow veterans of the Vietnam War by testifying to Congress in 1971 about atrocities he said were committed by U.S. forces in that conflict. "Don't look to us to block the airing of the program," FCC Chairman Michael Powell told reporters. "There is no rule that I'm aware of that would allow the commission, nor would it be prudent, to prevent the airing of programing." One former prisoner of war interviewed for the program said Kerry's remarks were used by the Vietnamese to undermine their morale, according to his video account on the Web site for the documentary. Democrats say the documentary is a political statement masquerading as news and have demanded the FCC and the Federal Election Commission determine whether its broadcast would violate any regulations. "The American public, which owns the airwaves that Sinclair would use for its partisan political purposes, expects the FCC to uphold the basic principle of fairness which is at the root of our democracy," said a letter to Powell from 85 House of Representatives' Democrats sent on Wednesday. Sinclair, based in Baltimore, Maryland, with 62 stations in 39 markets that include battleground states like Ohio and Florida, said the format of its "special news event" on prisoners of war in Vietnam has not been finalized. Sinclair owns 20 Fox affiliates, 19 WB stations, eight ABC affiliates, four NBC stations, three CBS stations, and two independent channels that reach about 24 percent of television households, according to its Web site. The company in April refused to air on its ABC stations the "Nightline" program that broadcast the names and photographs of the American soldiers who had been killed in Iraq. The company's owners and executives have given overwhelming to Republicans in the last 11 years, about $309,000 versus about $72,000 to Democrats and its political action committees, according to campaign contribution tracker PoloticalMoneyLine. Powell said even if the FCC did try to take action, it would likely violate free speech rights in the U.S. Constitution. "I don't know about you but I haven't seen it, I don't know who has seen it, I don't know whether there's anything implicated in FCC policy at all," said Powell, a Republican first appointed to the independent agency by President Bill Clinton and selected as chairman by President Bush. Sinclair's Web site invites people to urge Kerry to accept its invitation to participate in the program, adding that characterizations about its content are based on ill-informed sources. The documentary backers last month said on their Web site that they had joined forces with the Swift Boat Veterans for Truth, a group that launched a high-profile advertising campaign this summer attacking Kerry's service in Vietnam and his testimony to Congress. Other veterans, including one who commanded a boat alongside Kerry during the Vietnam war, have defended him. -------------------------------------------------------------------------------

It reeks of the 2000 presidential coup. A biased unsupportable decision by Republican Powell. Powell compares the forcing of television stations to air the anti-Kerry documentary to free speech. It makes as much sense as the USSC decision to stop the vote counting in Florida to preserve voters rights. ----------------- From the article: Democrats say the documentary is a political statement masquerading as news and have demanded the FCC and the Federal Election Commission determine whether its broadcast would violate any regulations. Highly unlikely the broadcast will be shut down. That would be a prior restraint. However it is much more likely that Sinclair will face a whopping fine for making a campaign contribution to Bush via this broadcast. Given a Kerry victory and maybe a Democratic Senate, and then a Democratic House after the 2006 elections, we can start turning the country around and getting it back on the right track.

Complete and utter BS, and shows how @$#*ed up the understanding of what constitutes free speech is. If I set up a pirate radio station at Sinclair's radio frequency, and use it to air Farenheit 911 2 days before election day, armed cops will take me away a few hours afterwards. Sinclair is LEASING the frequency, a SCARCE resource, from it's OWNER. If they only air one side, they are DENYING freedom of speech. They can show a biased Anti-Kerry documentary if they want, but the other side has a RIGHT to be given equal time as well. The "radiostations only show what's profitable" line simply does not wash, because the other side (eg Farenheit 911) is actually considerably more profitable. In fact, cancelling regular advertising to deliberately show something which would make sinclair vulnerable to boycotts qualifies as Fraud with respect to the stockholders. Quite frankly, I hope that thousands of freedom-minded pirate radio-station owners teach Sinclair a lesson: Try jamming Sinclair Radio stations with Anti-Bush propaganda. NOT the Kerry documentary but the same segment, say a day earlier or later. If governament does not enforce freedom of speech, freedom-minded citizens who are not afraid of civil disobedience should. In our country, we have freedom of the press as long as you own a press. In our country, both the rich and the poor are prevented from stealing bread and sleeping under bridges. There's no law against lying and there's no law against selling out your country. There are real fascists out there, and they pretty much run things. Rush lies more and faster than anyone since Joseph Goebbles, with whom he shares a lot (including a morphine addiction) and there's no way to stop him. These folks have every right to promote the needless, criminal, moronic slaughter of young Americans and Iraqies for the benefit of Dick Cheney's political base of oil company executives. Treason is quite legal under the constitution. It really depends on a well educated electorate, and as you know by listening to Rush, that is NOT a universal condition.

Free speech means free to be a goddam massive liar and start an illegal war with lies, but not to dare criticize our @$#*ing idiot 'president', huh? -- "You know, it's hard work to try to love her as best as I can, knowing full well that the decision I made caused her loved one to be in harm's way." -George W.
