Hi there y'all !
I got some good adivse last time I posted to these forums,so I'm back
for more !
(Though the misc.legal xpost is new)
I am having some doubt about placing an ad in the paper to sell a car
and wish to avoid solicitation from Autotrader called the "eggspurts"
at the Attorney General's office,and two different attorneys,and
couldn't get any acceptable responses.
The second attorney thought I had some good questions,and was
interested,but didnt know how to respond because no one ever tried
this before.

Heres the problem,and my solution I would like to find out if it is an
ironclad slam dunk.
I had a car in the paper last May and got lotsa calls from the
autotrader on my cell phone wasting my anytime minutes.
Autotrader didn't want to buy my car,but sell me their product.
I was aware of their product before placing my and chose to use an
alternative means because I didnt want to do business with them.
I asked to be put on the DO NOT CALL LIST ....
But they kept calling.
This time I planned to use my costly and valuable ad space to say
flat out ~>NO SOLICITATION<~ on the ad.
My first contact at the Attorney Generals office was absolutley
useless and her brain spun out completely at my radical question,so I
was forwarded to the "supervisor".
This supervisor told me to call the FTC.and get on the no call
list,and that even then,Autotrader has 6 months to solicit (harass) me
from the time I apply to this list.
And I should have thought of this six months ago.
I told her that wasn't my question,nor my intent.
I said I am going to put in black and white in the ad NO
SOLICITATION.
She told me corporations have "rights" too.
I said too many rights.
She told me that prisoners in jail have too many rights.
(Just so you know Lisa Madigans Offices Abu Ghraib mentallity)
I mentioned a magazine article I had in front of me with the
President of ING Direct dressed as a motorcycle thug in front of his
Chopper with the name of his gang on it's gas tank.~>ING Direct
This article was not critical of him,this article praised this
business thug in his biker fantasy wear
scowling in his picture with his close minded body language.
Arms crossed,and an evil look in his eye.
Sorta like the generic pose you see when gansta rappers finish their
act.
This is the internet version....
I guess you would have to subscribe to get the whole article,and I
dunno if they have the same cocky thug photo in the full version.

The conventional wisdom is the customer needs to be punished to keep
the thugs profitable.
Part of it is that customers who call too many times or ask too many
questions get "fired" and not allowed to be customers if they don't
shut up and keep their yaps shut.
From my print article.
"If the average customer phone call costs us $5.25 and the average
account revenue is $12.00 per month,all it takes is 100,000
~>misbehaving<~ customers for costs to go through the roof.
So when a customer calls too many times or wants to many exceptions
to the rule,our sales associate can basically say :
Look,this doesn't fit you.
You need to go back to your community bank,and get the kind of
contact you're comfortable with."
The bank fires about 3,600 of it's 2 million customers _every year_.

Punishment for _misbehaving_ customers....but they have "rights",and
are immune to consequences of their misbehavior.
I'm expected to field countless calls from Autotrader corporate
minions who don't want to buy my car?
I feel theres something wrong with this picture.
So my basic appeal here is to see if any of the real live people
here have any advice on how to get "tough"
with these solicitors without a 6 month grace period of having my cell
phone time wasted.
Does anyone know if NO SOLICITATION in the ad would be sufficient to
take effective and monetary retalliatory action against these
nuisances,and supercede this 6 month waiting period I "should have
thought of" prior to placing an ad in the paper to sell a car?
I think it should carry even more weight than the no call list.
Whatcha think ?

one minute per call, maybe six calls, so you mean you are using
up all this energy over 1/100th of the average monthly allotment?
Holy cow, just insult them when they call, and get over it..
I respond when a solicitor calls my store thusly

I doubt you will make the sales drone feel bad or stupid....
But, if autotrader has a 800 number, you might want to go to a payphone and
call them a few times (this way it won't use up your anytime minutes) and
tell them your going to be taking out a ad in a local paper, and you would
appreciate it if they don't call you over and over to sell you ad space.
When they sound puzzled, ask for a supervisor, and go thru the same issue
again with them.
Escalate again to the next level.... get on their no call list personally...
Heck, we had one guy escalating so high for something we were involved with
at Olivetti, that he had to start speaking italian to communicate with the
people he was calling...
Let them know you disapprove of the process.

I do...I'm very good at it.

True, I have gotten the call from Autotrader when I
put an ad in the local paper, but it was only one call
I actually just told them I had sold the car. (I wasn't thinking
too fast on my feet for that one<g>) and they did not
call me back.
I really would just put the ad in and deal with it
if they call you, perhaps your last experiance was
a weird fluke? It sure wasn't what I had happen, and
I can't think they always harass those they want to
do business with.

I doubt you will make the sales drone feel bad or stupid....
But, if autotrader has a 800 number, you might want to go to a payphone and
call them a few times (this way it won't use up your anytime minutes) and
tell them your going to be taking out a ad in a local paper, and you would
appreciate it if they don't call you over and over to sell you ad space.

Lemme get this straight I have to do a lotta work just so I don't get
harrased by Autotrader...I have to pre-emptivley harass them eh?
Thats insane.
Just shows how far people have drifted from didactic language to the
dialectic.
In dialectic-land there is no wrong or right.
I plan to put a no soliciting sign in my ad that I pay for,and if
they call I want to sue and win for thier blatant disregard of the use
of my advertising dollars I spend in good faith to attract buyers not
solicitors who will charge me to solicit in thier publications.
I do believe a written request in the ad should supercede the no call
list.
Heck, we had one guy escalating so high for something we were involved with

Well...they have a new CEO and the last car we sold here was within
the year.
They called after I told them the car was sold.
My whole "trolling" post was to see if anyone had enough knowledge of
the so called "legal system" to know if I put my ad in and specified
NO SOLICITORS (or something to that effect) they would have to leave
me alone "legally".
And if they violated that request they would be liable for the same
damages as the DO NOT CALL list.
But I guess my thoughts in regard to this stray too far from the herd
in this case.
The woman at the Atty General office said corporations have rights
too!
(More than me!)
So I wanted to get one to have them leave me alone this time around.
The principle.
And now on principle their harassment has delayed my putting of an ad
in the paper,because I would like to have the calls come to my cell
phone.
I have a very limited number of anytime minutes for the month.
I don't see why they should be allowed to waste them.
Last time the number of calls from them were extremely excessive.
It's not exactly terror,but they're a factor in my delayng placing an
ad till I can figure out how to get them to leave me alone this time.
Once bitten twice shy.
