Waitress Claims She Was Fired Over Weight Mother of Three Says She Was Let Go From Ruby Tuesday for Being too Big HICKORY, N.C., Oct. 19, 2004 -- Oct. 19, 2004 - Misty Watts -- a widow, mother of three, waitress and student -- has been struggling to get ahead for years on her own. So when she was let go from her job because she didn't "fit" the part, she felt alone and lost. "They didn't just hurt me. They really hurt my livelihood when they took my job, for no reason at all," Watts said. Watts has spent the last two years waiting tables at Ruby Tuesday in Hickory, N.C. After her husband died, her salary helped raise her three kids as she went to college part time. Watts says she felt as if she had been doing a good job, especially since she says she had been named employee of the month just days before she was let go by her district manager. "What he said was, 'Misty, you know I have to call you in here because your shirt does not fit you correctly,'" Watts said. "'Your shirt will never fit you correctly. And you will never be able to buy that one that does.' And he proceeded to tell me I don't fit the image." While the manager never said the word "overweight," Watts says she believes her termination was directly related to her weight. "I'm convinced that I was terminated because I'm overweight," she said. After Watts was terminated, one of her co-workers wrote a letter to the restaurant that Watts said touched her deeply. The letter said that Watts "did not deserve to lose the job that she lost. And Ruby Tuesdays doesn't deserve her. " While employees can't be fired based on age, sex, race and religion, it's not against the law to terminate based on weight. Legal scholar Lex Larson has written a dozen books on employment discrimination. He says employers are covered by the long-standing doctrine of Employment at Will, which states that employment is presumed to be voluntary and indefinite for both employees and employers. "An employer can fire you for any reason -- for no reason at all -- or even for the wrong reason," Larson said. Ruby Tuesday corporate officers deny Watts was fired for being overweight, but citing employee confidentiality, wouldn't say more about her. In a written statement, the company said it does not terminate employees based on their weight. "It is not Ruby Tuesday's policy to terminate people because of weight It is our policy to set high standards for performance and appearance." And: "We want our team members to wear shirts, blouses, and jeans that fit properly our people are the point of direct contact with all our guests. That is why it is so important for us to have team members who look and perform their best " Meanwhile, Watts says she would like someone from Ruby Tuesday to tell her they're sorry. "I would like an apology. Which I'm probably not going to get. But all I'd like is an apology to say 'hey, you know what, we fired you for an unethical reason. You know we fired you for just, just being you.' And you know I think that I deserve an apology for that," she said.

Sox, Captain's point was well made. There is as yet no real info on why this person was fired. Her weight is worth knowing if a charge of "fat discrimination" is to be levied. From the OP it seems possible that she was fired for presenting a poor image by being a sloppy dresser. Dave M.

As with many of these whiney ass stories this is high on feelings and low on information. If you have a dick you can't be a 'waitress' at Hooter's. If you're sooo @$#*ing fat that customers complain about it, and apparently she had soo much extra she couldn't get into a XXXL shirt without the risk of eye injury should a button pop off and cross the room at sub-light speed maybe putting someone's eye out, then you can't be a waitress....... I think the Manager screwed up. Who do you trust more, a skinny cook or a ain't-missing-no-meals sized cook? He shoulda put here in the kitchen.....

After you outgrow XXXL your shirt options are limited. I wouldn't consider their fare to be "high calorie #@($ for food". Gourmet fare, no, but decent food for the price. Is this woman such a putz that she's incapable of finding another job? Get over it, move on. Maybe lose some weight while she's at it. Apologize for firing her??? Gimme a break! Why is it that when something bad happens to some people it's always someone else's fault? Maybe she should apologize for being such a loser.

There is apparently more going on here than what has been in the media so far. I exchanged E-mail with a senior executive at Ruby Tuesday this morning, and they say that it had nothing to do with weight, and that her job is waiting for her if she wants to come back to work. It sounds like the woman and a district manager got into an argument, and the waitress walked, and is now claiming it was weight related. Anyone know the real story. -john- -- ==================================================================== John A. Let's say she was fired for being fat, even though RT denies it.. so what? Ruby Tuesday, like every company, has an image to uphold. If they don't want their consumer image to reflect fatness, they shouldn't be forced to. What's next, a lawsuit by a Calvin Klein model who breakouts out in zits and gets fired for being ugly? A job is not an entitlement. It's SUPPOSED to be a voluntary agreement between the employer and employee with an exchange of work vs money. That work can and many times is upholding a corporate image.

Given that this woman was employee of the month, she certainly did not have a problem doing the work. Since she did not gain the weight in the few days between being named employee of the month and getting canned, we can assume that she was essentially the same size when she was employee of the month. Being named the employee of the month indicates that Ruby Tuesday was proud of her service, so she apparently did fit their image. After all, she was the ideal image for a Ruby Tuesday team member. -john- -- ==================================================================== John A. here is the email from Ruby Tueday: "Thank you for contacting us. We have spoken with Misty Watts, who appeared on Good Morning America, offered her the opportunity to rejoin our team, and she has accepted. Misty was asked to leave our team for reasons other than her weight, but we made mistakes in how the decision to dismiss her was made and implemented, for which we have apologized. We are happy that the situation has been so successfully resolved and appreciate your comments and interest in Ruby Tuesday. "
