The law is pretty clear on a case like this, and has been since before President Clinton's administration. The assault will probably be classified as a misdemeanor, if it is pursued at all. I agree it was a prank. It would have been a good one as well, if no damage wa done. Unfortunately for the perpetrators, it backfired, and caused more than $1500.00 in damages, thus classifying it as a felony. The threshold for classifying criminal damage as a feloney used to be $100.00, but was increased (some time during the Clinton administration, I think) to account for the effects of inflation. An arbitrary threshold was set to ensure universal accountability. It prevents someone who criminally damages someone elses property from suffering any long term consequences simply by having enough money to effect repairs. No politically biased stretches of legal definitions are required to correctly label this incident a felony. It not only fits the legal definition, it fits the intent. Two young men made a decsion that has the potential to affect them for the rest of their lives (or at least involve them in a tremendous legal hassle). I think accountability is a good thing. DS
