Schwarz Law, the definition ----------------------------------------------- I noticed in several newsgroups that when certain posters are uneducated about certain subjects and feel that they lose an argument, they claim that the other poster is mentally ill to discredit him or her. That is of course not just unfair posting, but also libel per se. You can look it up in any law book or go to any legal website and you will find that legal experts all agree that it is libel per se to claim that somebody else suffers from an illness, e.g. mental illness, without having the expert proof of it. In court, you, the libel-originator, the defendant, has to prove that the person is mentally ill, and you have to pay the "experts", the court costs, the attorneys and damages to the plaintiff. Ask attorneys, a libel pro se case may cost you dearly, even your life savings. However, for those who become the victims of Internet bullies and people who libel others as being mentally ill, can immediately invoke the "Schwarz Law". They are entitled to tell the libeling person that they lose, in the newsgroups and in courts of laws. Barbara Schwarz

You're crazy if you think that.... Primarily because stating the poster is crazy doesn't identify a real person -- only "the person using that ID".

You are completely insane. As usual.

Huh? You missed the entire point. If I would be you I would read the posting before I heckle into it. Who posted anything about the identification of people? If you are afraid to be caught, you should be, as there are ways to trace any person on computers. Barbara Schwarz

YOU missed the entire point. If "Barbara Schwarz" could be identified as a real person, then you might be correct about the statement that "Barbara Schwarz is crazy" is actionable. However, the statement that "the poster is crazy" cannot be actionable, because the poster cannot be identified, unless the post is digitally signed. The person posting would have to identify herself publicly in order for the statement to be actionable -- so she has defamed herself.

Barbara Schwarz is a clinically diagnosed schizophrenic. Her consistent erratic & hostile behavior is typical for those affected with this mental disorder: Schizophrenia is a mental disorder that affects one in every one hundred people worldwide. It is defined as a psychotic disorder usually characterized by withdrawal from reality, illogical patterns of thinking, delusions, and hallucinations, and accompanied by various degrees of emotional, behavioral, and intellectual disturbances. Over the years, as families try to cope with the reality of having a loved one suffer from schizophrenia, they have come up with various early warning signs that correspond with the illness. These signs include unexpected hostility, depression, as well as bizarre behavior, noticeable social withdrawal, and drug and alcohol abuse. Additional warning signs include the inability to express joy, or cry, as well as several others. Compare these behaviors to the hundreds of inflammatory posts made by Barbara Schwarz in the last year and decide for yourself.

If I assert that the poster is crazy, and you assert that you are the poster, you are libeling yourself. _I'm_ not legally liable.

I don't assert that the poster is crazy, I think the posters are criminal. I don't libel myself. Garry Scarff, the cyber criminal stole my name and also posts with it. If he libels me with my name, I don't libel myself. Don't split hairs. As you very well know the ARS gang libels and defame me, an existing person. Lecture those guys, not me. www.MegaLaw.com Barbara Schwarz

No -- I asserted that whoever posted the article at the top of this thread was crazy. YOU are asserting that you are that person, hence you are libeling yourself. ....

They defamed me (or, to be precise, my handle) also. So what?
