1. Where can I download a copy of "Electronic Communications Privacy Act, 18
USC 2510"?
2. What is the effect of including the following in an email message?
"This communication constitutes an electronic communication within the
meaning of the Electronic Communications Privacy Act, 18 USC 2510, and
its disclosure is strictly limited to the recipient(s) listed on both the
TO: line and the CC: line. This communication, and all attachments hereto,
may contain XXXXXXX confidential and privileged material and is for the sole
use of the listed recipient(s). Receipt by anyone other than the listed
recipient(s) does not constitute a loss of the confidential or privileged
nature of the communication. Any review or distribution by others is
strictly prohibited. If you are not a listed recipient please contact the
sender by return electronic mail and delete all copies of this communication
from your computer."

Howard,
Have you consulted with an attorney about this odd notice that you wish
to use? This act deals with "wire-tapping" not with incorrectly sent faxes
or e-mails. Your claim that "Any review or distribution by others is
strictly prohibited." is not, in fact, prohibited by this act. While your
notice is quite fierce looking it is a toothless paper tiger.

If I got something like that in email I'd likely send back
a cease contact request, followed by complaints to the sender's
ISP if that was ignored.
"This communication constitutes an electronic communication within the
meaning of the Electronic Communications Privacy Act, 18 USC 2510, and
its disclosure is strictly limited to the recipient(s) listed on both the
TO: line and the CC: line.
It is extremely rare for a specific recipient to be listed on BOTH
the To: and Cc: line.
I would interpret "strictly limited to the recipient(s) listed ..."
as excluding role accounts, so if it's listed as something like
hostmaster@... which goes to mailbox, that's not me.
This communication, and all attachments hereto,
may contain XXXXXXX confidential and privileged material and is for the sole
use of the listed recipient(s). Receipt by anyone other than the listed
recipient(s) does not constitute a loss of the confidential or privileged
nature of the communication. Any review or distribution by others is
strictly prohibited. If you are not a listed recipient please contact the
sender by return electronic mail and delete all copies of this communication
from your computer."
I'm not a listed recipient unless my personal name *and* personal
(non-role) email address apears on the To: line and my personal
name *and* personal (non-role) email address appears on the Cc:
line.
