Thanks, got with a lawyer today. Not a pretty thing to deal with but we'll
see what happens.
Tough to do anything without a lawyer on your side, but a lawyer may
not be able to do much more than keep the maximum penalties away from
you. Kansas does not countenance plea bargains in DUI cases, and
diversion is available only on the first DUI in your lifetime. See an
informative Kansas DUI lawyer's Web site at
http://www.ks-drunkdrivinglawyer.com/stateinfo/summ.htm
There are the usual defenses (the analyzer was not calibrated, not
operated properly, or the like; if you aren't up on a 0.08 percent per
se violation, you can try to show you weren't really under the
influence), but getting your affairs in order (because you're looking
at 5 days to a year in jail and a year license suspension) would be
prudent.
Definitely get your act together before you risk a third DUI, because
that's a felony in Kansas.
