NY Small Claims Ct Statute of Limitations on residential rental damage
Tenant moved out of an apartment in my two family rental, leaving $2,600 in
damage and used the security deposit as the last months rent even thought the
lease stated that it could not be used as the last months rent. Any way, I am
in New York State and need to know how many years I have to take the case to
court for non-payment by the tenant for their damages to the apartment?

Unless otherwise stipulated in the lease, you have three years to sue
for property damage.
But you really shouldn't wait too long.
