3.Judges not faithful to the law..not fair or impartial...rulings in

Troops put tough questions to Rumsfeld

Dec. 8: Secretary of Defense Donald Rumsfeld answers questions from
troops during a visit to a U.S. base in Kuwait.
MSNBC
The Associated Press
CAMP BUEHRING, Kuwait - After delivering a pep talk designed to energize
troops preparing to head for Iraq, Defense Secretary Donald H. Rumsfeld
got a little =E2=80=9Ctalking to=E2=80=9D himself from disgruntled
soldiers.
In his prepared remarks, Rumsfeld urged the troops =E2=80" mostly
National Guard and Reserve soldiers =E2=80" to discount critics of the
war in Iraq and to help =E2=80=9Cwin the test of wills=E2=80=9D with the
insurgents.
Some of soldiers, however, had criticisms of their own =E2=80" not of
the war itself but of how it is being fought.
Army Spc. Thomas Wilson, for example, of the 278th Regimental Combat
Team that is comprised mainly of citizen soldiers of the Tennessee Army
National Guard, asked Rumsfeld in a question-and-answer session why
vehicle armor is still in short supply, nearly three years after the war
in Iraq.
=E2=80=9CWhy do we soldiers have to dig through local landfills for
pieces of scrap metal and compromised ballistic glass to uparmor our
vehicles?=E2=80=9D Wilson asked. A big cheer arose from the
approximately 2,300 soldiers in the cavernous hangar who assembled to
see and hear the secretary of defense.
Rumsfeld hesitated and asked Wilson to repeat his question.
=E2=80=9CWe do not have proper armored vehicles to carry with us
north,=E2=80=9D Wilson said after asking again.
Rumsfeld replied that, =E2=80=9CYou go to war with the Army you
have,=E2=80=9D not the one you might want, and that any rate the Army
was pushing manufacturers of vehicle armor to produce it as fast as
humanly possible.
Level 3 armor
And, the defense chief added, armor is not always a savior in the kind
of combat U.S. troops face in Iraq, where the insurgents=E2=80=99 weapon
of choice is the roadside bomb, or improvised explosive device that has
killed and maimed hundreds, if not thousands, of American troops since
the summer of 2003.
=E2=80=9CYou can have all the armor in the world on a tank and it can
(still) be blown up,=E2=80=9D Rumsfeld said.

WP: U.S. says Syria aiding rebels
Asked later about Wilson=E2=80=99s complaint, the deputy commanding
general of U.S. forces in Kuwait, Maj. Gen. Gary Speer, said in an
interview that as far as he knows, every vehicle that is deploying to
Iraq from Camp Buehring in Kuwait has at least =E2=80=9CLevel 3=E2=80=9D
armor. That means it at least has locally fabricated armor for its side
panels, but not necessarily bulletproof windows or protection against
explosions that penetrate the floorboard.
Speer said he was not aware that soldiers were searching landfills for
scrap mental and used bulletproof glass.
Priority for best equipment
During the question-and-answer session, another soldier complained that
active-duty Army units sometimes get priority over the National Guard
and Reserve units for the best equipment in Iraq.
=E2=80=9CThere=E2=80=99s no way I can prove it, but I am told the Army
is breaking its neck to see that there is not=E2=80=9D discrimination
against the National Guard and Reserve in terms of providing equipment,
Rumsfeld said.
Yet another soldier asked, without putting it to Rumsfeld as a direct
criticism, how much longer the Army will continue using its
=E2=80=9Cstop loss=E2=80=9D power to prevent soldiers from leaving the
service who are otherwise eligible to retire or quit.
Rumsfeld said that this condition was simply a fact of life for soldiers
at time of war.
=E2=80=9CIt=E2=80=99s basically a sound principle, it=E2=80=99s nothing
new, it=E2=80=99s been well understood=E2=80=9D by soldiers, he said.
=E2=80=9CMy guess is it will continue to be used as little as possible,
but that it will continue to be used.=E2=80=9D
In his opening remarks, Rumsfeld stressed that soldiers who are heading
to Iraq should not believe those who say the insurgents cannot be
defeated or who otherwise doubt the will of the military to win.
=E2=80=9CThey say we can=E2=80=99t prevail. I see that violence and say
we must win,=E2=80=9D Rumsfeld said.

The Canons of Judicial Conduct State that a Judge must be "Faithful to
the Law"
and "Fair and Impartial" ...this "Policy" is Misrepresentation of Real
Contract Law which states there Must be a Definite, Set , Defined time
period for a contract to be Binding...~ a Petition to void this should
have been granted.
~So here we have again as Jail for Judges association has stated Rulings
that are Unconstitutional and No Law Applied.
No one need obey a law that is Unconstitutional..it has no legal
Validity....
You can not have 2 laws that contradict each other and both be
legal...Of course ....it is not a legal war anyway as there is no WMD..

Eight soldiers are going to court to challenge the Army=E2=80=99s
stop-loss policy, which requires them to serve longer than the terms of
their enlistment contracts.
The soldiers are filing suit in federal court in Washington, D.C. with
the help of the Center for Constitutional Rights.

Rights
Five of the soldiers who are suing are stationed in Iraq, two are in
Kuwait on their way to Iraq and one is home on leave from Iraq, but
about to be shipped back.
Only one of the plaintiffs is named: Arkansas National Guard Spc. David
Qualls, who signed up in July 2003 for what he was told would be a
one-year stint in the guard.
In March 2004 he was sent to Taj, Iraq, where he remains, more than four
months after his enlistment was supposed to have ended.
He's been told he will remain on active duty in Iraq until next year.
"I believe I served my country honorably," Qualls said.
=E2=80=9CEven though I did not expect to be rotated to Iraq, I did my
time and served to the best of my ability. And I was proud to serve. But
the Army made an agreement with me and I expected them to honor it. Iraq
is a very dangerous place and I have a family to support. I did what I
said I would; it's only fair that the Army do the same,=E2=80=9D he said
in a prepared release.
Under the Pentagon's "stop-loss" program, the Army can extend
enlistments during war or national emergencies.
Stop-loss orders apply to soldiers whose enlistments are scheduled to
end 90 days before deployment, during deployment or 90 days after
deployment.
The lawsuit says the policy is a breach of the service contract
because it extends the length of service without a soldier's
consent. =A0=A0=A0=A0=A0=A0=A0

Military hardware wearing faster than expected
Insurgent attacks, desert conditions take toll
FREE VIDEO
Dec. 10: Military officials say all major military equipment in Iraq is
breaking down or wearing out at a faster rate than first estimated.
NBC's Jim Miklaszewski reports.

Before the war in Iraq, Pentagon officials had predicted that by now,
Iraq would be pacified and most American troops would be long gone. But
as the war drags on, the toll it's taking is far greater than expected
=E2=80" not only on the soldiers, but their equipment as well.
In fact, senior military officials now tell NBC News all major military
equipment =E2=80" trucks, tanks, helicopters and even guns =E2=80" is
breaking down or wearing out at a faster rate than first estimated.
It's not only due to the harsh desert conditions in Iraq, but the enemy
has proven far more effective and resilient than anyone in the Pentagon
had imagined. That's putting a far greater load on such equipment as
Humvees and tanks =E2=80" which are working at ten-times the normal
rate.
"We're running the tracks off them," says NBC military analyst Gen.
Barry McCaffrey (ret.) "They're going, instead of 800 miles a year,
8,000 miles a year and we're not rebuilding it."
=A0Related story
U.S. to boost armored Humvee production
It's also putting a tremendous stress on the military=E2=80=99s ability
to fix them. The number of tanks requiring major repairs is up 600
percent. Before the war, some 300 Humvees a year would go through a
major overhaul. Today that number has skyrocketed to 5,700 =E2=80" a
jump of nearly 2,000 percent.
"Our folks are in a constant cycle of repair, repair, repair to return
this equipment to the force," says Gary Motsek, with the U.S. Army
Support Operations.
And the cost is staggering. Last year the Army got an additional $1
billion to pay for wartime repairs. This year the price tag is expected
to climb to $9 billion.
Even then, it's an increase in military spending that will extend well
beyond the war.
"Should the war end today, it would take two years for the United States
Army to replenish itself and bring its equipment back to proper state,"
says Rep. Ike Skelton, D-Mo., and a member of the House Armed Services
Committee.
But in fact, the war appears nowhere near ending. Friday, Military
officials said current plans call for the same number of American troops
to remain in Iraq for at least the next two years.

They were universally hated. It's only a couple of generations later that
most Americans have never actually fired a battle rifle and the
poodle-shooter is barely tolerated at that.
get the feeling that the Russian weapons are better than U.S. ones in
actual combat conditions.....
Depends on the context- a .30 cal. battle weapon seems preferrable under
most circumstances, but an assault carbine has it's place (riding in the
jeep with lieutenants seems appropriate).
........so why don't
they re-design them for sand and and such or Copy Russian

Judicial Accountability and Constitutional Issues
Constitution Supreme Clause
~DNC Home | Blog |
With their victories in November, Republicans not only extended their
control over the White House, but aggressively expanded their hold over
both the Senate and the House of Representatives. As a result, the
Washington Republicans are now in the best position they have ever been
to pursue and put in place their extremist agenda -- an agenda that will
place the needs of the special interests over the desires of the average
American for a government that creates opportunity, fairness, and
security.
Here are a few of the ways they're planning to threaten our basic
rights:
Shifting the tax burden to working families. They'll call it "reform,"
but they've got only one thing in mind: shifting the tax burden from the
wealthiest Americans onto the backs of the lower- and middle-class
taxpayers. They're already floating ideas like a national sales tax that
will make average families pay more.
Undermining Social Security. The Bush administration is gearing up to
reintroduce its disastrous plan to undermine the retirement security of
every single American. Their plan ensures a guaranteed benefit cut for
all Americans and creates a new debt of one trillion dollars for our
children and grandchildren.
Packing the Supreme Court with extremists. This is the greatest danger
to our fundamental constitutional rights that will affect all our lives
for decades to come. A Supreme Court retirement could come at any
moment, and three or more justices could retire over the course of
Bush's term. If Bush nominates extremist judges to the nation's highest
court for lifetime appointments -- as he has done with the lower courts
-- all the rights we hold dear will be at risk.
The Democratic Party will be there to fight all of these battles. And
we're depending on your help to win them. It is up to us to protect our
values from the Republicans' attacks. They want to take a narrow
election victory and cast it into a broad mandate for an extreme agenda.
In the coming weeks and months, we'll be telling you about what we're
doing to win these fights, and how you are the key to helping us win.
Thank you,

And so the blunder continues. Did Rumsfeld bring any armor with him

Or just more body bags? For this Vietnam like quagmire, so similar to
McNamara and his blunders, excuses. rifles recalls and such... They
just void their conscience...they are "Plantation boys"..".yes men" as
they are called...widow makers... and let the soldiers die in stupid
repetitious ambushes.
So predictable every day on the news. And their explanations for the
needless deaths so predictable also.
They put Saddam Hussein in power. Now there is no WMD and now they
captured Saddam Hussein. Law of Diminishing Returns.
Iraq was not responsible for 9/11. And that was the second attack on
the same building.
And nothing done about the Israel/Palestine land conflict.
